HLS 24RS-1118 ENGROSSED 2024 Regular Session HOUSE BILL NO. 756 BY REPRESENTATIVES MCMAKIN, BOYD, DOMANGUE, MARCELLE, AND NEWELL PUBLIC BUILDINGS/ST CAPL: Provides relative to state capitol complex and the allocation of space in the state capitol 1 AN ACT 2To amend and reenact R.S. 49:150.1(A) through (G), (H)(1)(a), and (I)(1)(a), relative the 3 state capitol complex; to provide for the use and allocation of space within the state 4 capitol complex; to make technical changes; and to provide for related matters. 5Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 49:150.1(A) through (G), (H)(1)(a), and (I)(1)(a) are hereby amended 7and reenacted to read as follows: 8 ยง150.1. State capitol complex; allocation of space; maintenance; law enforcement 9 officer and firefighter memorial; Gold Star Families monument; 10 African-American military service members monument 11 A. Notwithstanding any other provision of law to the contrary, and 12 particularly any contrary provision of R.S. 49:146 or R.S. 39:127, the allocation and 13 use of space within the state capitol and any additions or appurtenances thereto, 14 pentagon courts barracks buildings, and the Old Arsenal Magazine Museum shall be 15 as provided in this Subpart Section. The provisions of this Subpart shall apply to the 16 subbasement, basement, and all floors of the state capitol, all buildings in the 17 pentagon courts, and the Old Arsenal Museum. 18 B. The fourth floor and three floors through the sixth floor of the state capitol 19 building shall be allocated to and be used by the governor for his office, the offices Page 1 of 6 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 24RS-1118 ENGROSSED HB NO. 756 1 of the members of his personal staff, and the offices of such other personnel of 2 agencies within the office of the governor as the governor shall determine. 3 C. In addition to the provisions of Subsection B of this Section, four floors 4 of the state capitol building shall be designated for use by the attorney general and 5 one 6 (1) The third floor of the state capitol building shall be designated for use by 7 the treasurer and the secretary of state commissioner of agriculture. At least one 8 floor of the state capitol shall be designated for use by the secretary of state. At least 9 one floor shall be designated for use by the attorney general. A portion of another 10 floor of the state capitol shall be designated for use by the treasurer. 11 (2) That space leased to members of the press on July 1, 1979, by the 12 division of administration shall constitute the press area of the state capitol and shall 13 be under the control of the governor; provided however, if renovations require 14 temporary or permanent reassignment of the press to another area of the state capitol 15 is required, such reassignment shall be determined and made jointly by the governor, 16 the speaker of the House of Representatives, and the president of the Senate. 17 D. The designation of the eight floors as set forth in Subsections B and C of 18 this Section, not including the fourth floor, shall be jointly determined by the 19 governor, the speaker of the House of Representatives, and the president of the 20 Senate. 21 E.(1) All areas of the state capitol and any additions or appurtenances 22 thereto, pentagon courts barracks buildings, and Old Arsenal Magazine Museum not 23 allocated under the provisions of Subsections B and C of this Section shall be for the 24 sole use of the legislature, its agencies and officers, and the employees of the 25 legislature and its agencies. In addition, the former nurses' dormitory at the Our 26 Lady of the Lake Hospital, located on Capitol Lake, shall be for the sole use of the 27 legislature, its agencies and officers, and the employees of the legislature and its 28 agencies until such time as it shall be renovated in accordance with the Capitol Page 2 of 6 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 24RS-1118 ENGROSSED HB NO. 756 1 Complex Master Plan and it shall then revert to the control of the division of 2 administration. 3 (2) The time at which such renovation shall begin shall be determined jointly 4 by the president of the Senate, the speaker of the House of Representatives, and the 5 commissioner of administration. The allocation of these areas shall be made by the 6 legislature by joint rule or through the Legislative Budgetary Control Council. 7 The designation of the use of all areas of the state capitol and any additions 8 or appurtenances thereto not otherwise provided by Sections B and C of this Section 9 shall be determined either jointly by the speaker of the House of Representatives and 10 the president of the Senate or determined by the legislature by joint rule. 11 (3) The pentagon barracks buildings shall be allocated as follows: 12 (a) Building A shall be allocated to the House of Representatives, and 13 allocation and use of space within that building shall be as determined by the speaker 14 of the House of Representatives. 15 (b) Buildings B and C shall be allocated to the House of Representatives and 16 the Senate and the allocation and use of space within those buildings shall be as 17 determined jointly by the speaker of the House of Representatives and the president 18 of the Senate. 19 (c) Building D shall be allocated to the Senate, and the allocation and use of 20 space within the building shall be as determined by the president of the Senate. 21 (4) The Old Arsenal Magazine Museum shall be allocated to the legislature, 22 and its management and use shall be as determined jointly by the speaker of the 23 House of Representatives and the president of the Senate. 24 F. Except as otherwise provided in this Section, the director of the office of 25 state buildings shall have charge of the maintenance of the Old Arsenal Magazine 26 Museum and the management, operation, and maintenance of the state capitol 27 building, pentagon courts barracks buildings, the Old Arsenal Museum, and the 28 capitol complex grounds. HLS 24RS-1118 ENGROSSED HB NO. 756 1 Subsection, the director shall be under the authority and direction of the governor, 2 the speaker of the House of Representatives, and the president of the Senate. 3 G. In accordance with R.S. 25:781 through 785 and subject to the joint 4 approval and oversight of the governor, the president of the Senate, and the speaker 5 of the House of Representatives, the director of the office of state buildings shall: 6 (1) Set aside and maintain an area on the grounds of the state capitol east of 7 the Old Arsenal Magazine Museum for a memorial honoring law enforcement 8 officers and firefighters who are killed in the line of duty;. 9 (2) Plan, implement, and maintain the memorial itself; and . 10 (3) Establish and maintain a fund to consist of private donations, grants, and 11 other similar, but non-state nonstate, monies which he shall use with respect to the 12 establishment, and maintenance of the memorial. 13 H.(1) Subject to the joint approval and oversight of the governor, the 14 president of the Senate, and the speaker of the House of Representatives, the director 15 of the office of state buildings shall do all of the following: 16 (a) Set aside and maintain an appropriate area accessible to the public on the 17 east side of the state capitol on the grounds surrounding the Old Arsenal Magazine 18 Museum known as the Louisiana Veterans Memorial Park, for a monument honoring 19 the sacrifices of Louisiana Gold Star Families. 20 * * * 21 I.(1) Subject to the joint approval and oversight of the governor, the 22 president of the Senate, and the speaker of the House of Representatives, the director 23 of the office of state buildings shall do all of the following: 24 (a) Set aside and maintain an appropriate area accessible to the public on the 25 east side of the state capitol on the grounds surrounding the Old Arsenal Magazine 26 Museum, known as the Louisiana Veterans Memorial Park, for a monument 27 honoring the service and sacrifices of African-American military service members 28 and their families throughout the history of the United States of America, including 29 their service and sacrifices in the longest siege in American history at Port Hudson Page 4 of 6 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Present law relative to the allocation and use of space in the capitol complex, provides that notwithstanding any other law to the contrary, the allocation and use of space within the state capitol, pentagon court buildings, and the Old Arsenal Museum, including the subbasement, basement, and all floors of the state capitol, all buildings in the pentagon court, and the Old Arsenal Museum, shall be as follows: (1)The fourth floor and three floors of the state capitol building shall be allocated to and be used by the governor for his office, the offices of the members of his personal staff, and the offices of such other personnel of agencies within the office of the governor as the governor shall determine. (2)Four floors of the state capitol building shall be designated for use by the attorney general and one floor of the state capitol building shall be designated for use by the treasurer and the secretary of state. That space leased to members of the press on July 1, 1979, by the division of administration shall constitute the press area of the capitol and shall be under the control of the governor; however, if renovations require reassignment of the press, such reassignment shall be determined by the governor, the House speaker, and Senate president. (3)The designation of the eight floors set forth in (1) and (2), not including the fourth floor, shall be jointly determined by the governor, the House speaker, and Senate president. (4)All areas of the state capitol, pentagon court buildings, and Old Arsenal Museum not allocated in (1) and (2) shall be for the sole use of the legislature. In addition, the former nurses' dormitory at the Our Lady of the Lake Hospital, located on Capitol Lake, shall be for the sole use of the legislature until such time as it shall be renovated in accordance with the Capitol Complex Master Plan and it shall then revert to the control of the division of administration. The allocation of these areas shall be made by the legislature by joint rule or through the Legislative Budgetary Control Council. (5)Provides that except as otherwise provided in existing law, the superintendent of state buildings shall have charge of the management, operation, and maintenance of the state capitol building, pentagon court buildings, the Old Arsenal Museum, and the capitol complex grounds and that in the performance of such duties, the superintendent shall be under the authority and direction of the governor, the House speaker, and the Senate president. HLS 24RS-1118 ENGROSSED HB NO. 756 (6)Provides that subject to the joint approval and oversight of the governor, the Senate president, and House speaker, the superintendent of state buildings shall set aside and maintain areas on the grounds of the state capitol for specified memorials. Proposed law retains present law except: (1)Includes additions or appurtenances to state capitol and deletes specific reference to the subbasement, basement, and all floors of the capitol. (2)Changes references from state capitol building to state capitol and Old Arsenal Museum to Old Arsenal Magazine Museum. (3)Changes reference from pentagon courts buildings to pentagon barracks buildings and specifies that Building A is allocated to the House, and allocation and use of space within the building is determined by the speaker; Building D is allocated to the Senate, and allocation and use of space within the building is determined by the president; and Buildings B and C are allocated to the House and the Senate, and allocation and use of space within the building is determined jointly by the speaker and the president. (4)Deletes reference to the former nurses' dormitory at the Our Lady of the Lake Hospital. (5)Removes provisions allocating four floors to the attorney general and one floor to the treasurer and secretary of state. Provides that the third floor is allocated to the treasurer and the commissioner of agriculture. Provides that the treasurer shall have space on another floor. Provides that at least one floor shall be allocated to the secretary of state and at least one floor shall be allocated to the Attorney General. Maintains that the designation of the floors to the executive branch officials shall be jointly determined by the governor, the speaker of the House of Representatives, and the president of the Senate. (6)Specifies that the designation of the floors not otherwise specifically designated shall be jointly determined by the speaker of the House and the president of the Senate or by the legislature by joint rule. (Amends R.S. 49:150.1(A)-(G), (H)(1)(a), and (I)(1)(a)) Summary of Amendments Adopted by House The Committee Amendments Proposed by House Committee on House and Governmental Affairs to the original bill: 1. Provide that at least one floor shall be allocated to the secretary of state and that at least one floor shall be allocated to the attorney general rather than those officials sharing a floor. 2. Remove specific reference to the State Bond Commission relative to use of space on a floor allocated to the treasurer.
