VACCINES/VACCINATION: Provides relative to messenger ribonucleic acid vaccinations
and blood donations
1 AN ACT
2To enact R.S. 40:643, relative to blood donation; to require blood donors to disclose vaccine
3 status; to allow a recipient of a blood transfusion to request the vaccine status of the
4 donated blood in certain circumstances; to require the promulgation of rules; to
5 provide for an effective date; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:643 is hereby enacted to read as follows:
8 ยง643. Disclosure of messenger ribonucleic acid vaccinations for blood donations;
9 labeling; right to request blood
10 A. Any person who collects human blood donations for the purpose of
11 providing blood for human blood transfusion shall require blood donors to disclose
12 whether the blood donor has received a COVID-19 vaccine or a messenger
13 ribonucleic acid vaccine during the donor's lifetime.
14 B. An individual or entity that collects blood from a donor who received a
15 COVID-19 vaccine or messenger ribonucleic acid vaccine shall record the vaccine
16 status of the donor on the receptacle containing the donated blood.
17 C. In a nonemergency situation, as determined by a licensed healthcare
18 professional, a person receiving a blood transfusion has the right to request blood
19 based on whether the blood originated from a person who has received a COVID-19
20 vaccine or a messenger ribonucleic acid vaccine, if the requested blood is available.

1 D. The Louisiana Department of Health shall promulgate rules and
2 regulations in accordance with the Administrative Procedure Act to implement the
3 provisions of this Section.
4 Section 2. This Act shall become effective on September 1, 2024.

Abstract: Provides for donation and transfusion of blood collected from a person who
received certain vaccinations.
Proposed law requires any person donating blood to disclose whether he has received a
COVID-19 vaccination or messenger ribonucleic acid (mRNA) vaccination.
Proposed law requires any person collecting blood to clearly label the receptacle containing
the collected blood with a donor's vaccination status.
Proposed law permits a recipient of a blood transfusion to request blood based on if an
individual has received a COVID-19 or mRNA vaccination during a nonemergency
situation, as determined by a licensed healthcare professional if the blood is available.
Proposed law tasks the La. Dept. of Health with developing rules and regulations to
implement the provisions of proposed law.
Effective Sept. 1, 2024.
