HOUSE BILL NO. 927

LOCAL GOVERNMENT:  Provides with respect to certain permits required by parishes
and municipalities
1	AN ACT
2To amend and reenact R.S. 33:4886, relative to parishes and municipalities; to provide
3 relative to permits required by parishes and municipalities; to prohibit any parish or
4 municipality from requiring a permit for certain services provided by an authorized
5 utility provider; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 33:4886 is hereby amended and reenacted to read as follows:
8 ยง4886.  Permits; certain utility services; parishes and municipalities
9	Notwithstanding any other provision of law to the contrary, no parish
10 governing authority or municipal governing authority shall require any person who
11 holds an account with an authorized utility provider and whose account is being
12 charged by the provider for electric services provided to a dwelling located in the
13 state of Louisiana to acquire a permit from the respective parish or municipal
14 governing authority in which the dwelling is located for the purpose of changing the
15 name of the person listed as the account holder if a person who holds an account with
16 an authorized utility provider and whose account is being charged by the provider
17 for electric services provided to a dwelling located in the state of Louisiana transfers
18 the account to another person, the parish or municipal governing authority shall not
19 require the new account holder to acquire a permit from the respective parish or
20 municipal governing authority to continue the electric services being provided by the

1 authorized utility provider to any such dwelling.  Nothing in this Section shall
2 prohibit regulatory inspection or enforcement regarding on-site sewerage disposal
3 systems, nor shall it prohibit a parish or municipal governing authority from
4 collecting past due utility debt.

Abstract:  Prohibits a parish or municipality from requiring certain persons to acquire a
permit with respect to the transfer of electric services provided by an authorized
utility provider.
Present law prohibits parish and municipal governing authorities from requiring any person,
who is an account holder with an authorized utility provider and whose account is being
charged by the provider for electric services provided to a dwelling located in the state to
acquire a permit to change the name of the person listed as the account holder.
Proposed law instead provides that if a person who holds an account with an authorized
utility provider and whose account is being charged by the provider for electric services
provided to a dwelling located in the state transfers the account to another person, the parish
or municipal governing authority is prohibited from requiring the new account holder to
acquire a permit to continue electric services provided to such dwelling.
