HOUSE BILL NO. 932

RACING/HORSE:  Provides relative to purse supplements
1	AN ACT
2To amend and reenact R.S. 4:147.1(D), 183.2(A), and 217(D)(3) and R.S. 27:438(B)(5) and
3 to enact R.S. 27:361(B)(4)(d), relative to purse supplements; to provide for the
4 transferring and receiving of purse funds; to provide for the disposition of accrued
5 interest on undistributed monies at a race meeting; to provide for purse supplements
6 designation and distribution; to provide that purse supplements interest be used for
7 Louisiana bred races; to provide for the distribution of video draw poker device
8 revenues; and to provide for related matters.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 4:147.1(D), 183.2(A), and 217(D)(3) are hereby amended and
11reenacted to read as follows: 
12 §147.1.  Commission; purse supplements; additional or substitute races and race
13	days; force majeure

15	D.(1)  Notwithstanding any provision of law to the contrary and upon
16 agreement of the Horsemen's Benevolent and Protective Association and the
17 involved licensed eligible facilities transferring and receiving purse funds, the
18 commission may approve the transfer of slot machine proceeds received any purse
19 funds for thoroughbred race purses from one licensed eligible facility to another
20 licensed eligible facility to supplement thoroughbred purses at a thoroughbred race

1 meet.  Funds transferred pursuant to this Paragraph shall be awarded within one year
2 of the date of transfer.
3	(2)  Notwithstanding any provision of law to the contrary and upon
4 agreement of the Horsemen's Benevolent and Protective Association and the
5 involved licensed eligible facilities transferring and receiving purse funds, the
6 commission may approve the transfer of slot machine proceeds received any purse
7 funds for quarter horse race purses from one licensed eligible facility to another
8 licensed eligible facility to supplement quarter horse purses at a quarter horse race
9 meet.  Funds transferred pursuant to this Paragraph shall be awarded within one year
10 of the date of transfer.

12 §183.2.  Disposition of accrued interest on undistributed monies at a race meeting
13	A.  Monies designated for purses under R.S. 4:183(A) shall be remitted to the
14 Horsemen's Benevolent and Protective Association within ten business days to be
15 deposited in a separate interest-bearing account when earned and shall remain in that
16 account until the first day of the next race meeting of the appropriate breed.  Monies
17 earned as interest on that account shall be added to those designated for Louisiana
18 bred purses under R.S. 4:183(A) and shall be considered part of the gross purses as
19 defined therein.

25	(3)  Monies designated for purse supplements under in accordance with this
26 Subsection that are not used during the current race meeting shall be placed in an
27 interest bearing account and shall remain in that account until the next licensed race
28 meeting held at the appropriate facility.  At such time, the funds in that account and
29 the interest earned thereon shall then be used for purse supplements as provided

1 herein.  All interest earned on purses and purse supplements in accordance with this
2 Section shall be for only Louisiana bred races.

4 Section 2.  R.S. 27:438(B)(5) is hereby amended and reenacted and R.S.
527:361(B)(4)(d) is hereby enacted to read as follows: 
6 §361.  Conduct of slot machine gaming; temporary conduct

8	B.  As a condition of licensing and to maintain continued authority for the
9 conduct of slot machine gaming at the licensed eligible facility, the owner of the
10 licensed eligible facility shall:

12	(4)  Contribute to the support of pari-mutuel wagering facilities in the state
13 at large and the horse breeding industry by paying annually from the annual net slot
14 machine proceeds received from slot machine gaming operations at the licensed
15 eligible facility as provided in this Paragraph:

17	(d)  All interest earned on funds in this Section shall be used for only
18 Louisiana bred races.

20 §438.  Distribution of video draw poker device revenues; particular licensed
21	establishments; pari-mutuel wagering facilities

23	B.  Revenues earned for purse supplements under Subsection A of this
24 Section shall be disbursed, accounted for, and used as follows:

26	(5)  Monies earned for purse supplements from video draw poker devices,
27 and interest earned on such monies, shall be added to all other monies currently
28 provided for purses and purse supplements under other provisions of law, and
29 distributed as follows:

1	(a)  The purses and purse supplements for thoroughbred races shall be used
2 at the eligible facility's current live thoroughbred race meet, or if live thoroughbred
3 racing is not being conducted, used at the eligible facility's next live thoroughbred
4 race meet.  All interest earned on purses and purse supplements in accordance with
5 this Section shall be for only Louisiana bred races.
6	(b)  The purses and purse supplements for quarter horse races shall be used
7 at the eligible facility's current live quarter horse race meet, or if live quarter horse
8 racing is not being conducted, used at the eligible facility's next live quarter horse
9 race meet.  All interest earned on purses and purse supplements in accordance with
10 this Section shall be for only Louisiana bred races.

Abstract: Provides relative to purse supplements.
Present law provides that notwithstanding any provision of law to the contrary and upon
agreement of the Horsemen's Benevolent and Protective Association (HBPA) and the
involved licensed eligible facilities, the commission may approve the transfer of slot
machine proceeds received for thoroughbred or quarter horse race purses from one licensed
eligible facility to another licensed eligible facility to supplement quarter horse or
thoroughbred purses at a quarter horse or thoroughbred race meet. 
Proposed law amends present law to state that notwithstanding any provision of law to the
contrary and upon agreement of the HBPA and the licensed eligible facilities transferring
and receiving purse funds, the commission may approve the transfer of any purse funds for
thoroughbred or quarter horse race purses from one licensed eligible facility to another
licensed eligible facility to supplement thoroughbred or quarter horse purses at a
thoroughbred or quarter horse race meet. 
Present law states that monies designated for purses under present law shall be remitted to
the HBPA within 10 business days to be deposited in a separate interest-bearing account
when earned and shall remain in that account until the first day of the next race meeting of
the appropriate breed.  Monies earned as interest on that account shall be added to those
designated for purses under present law and shall be considered part of the gross purses as
defined therein.
Proposed law amends present law to clarify that the monies earned as interest on that
account shall be added to those designated for La. bred purses under present law and shall
be considered part of the gross purses as defined therein.

Present law provides for purse supplements and their designation and distribution.
Proposed law amends present law to add that all interest earned on purses and purse
supplements in accordance with present law shall be for only La. bred races.
Present law provides for the conduct of slot machine gaming.
Proposed law amends present law to add that all interest earned on funds in present law shall 
be used for only La. bred races.
Present law provides for the distribution of video poker device revenues, particular licensed
establishments, and pari-mutual wagering facilities.
Proposed law amends present law to add that all interest earned on purses and purse
supplements in accordance with this present law shall be for only La. bred races.
