ENROLLED 2024 Regular Session HOUSE BILL NO. 932 BY REPRESENTATIVES BOYER AND CHASSION 1 AN ACT 2 To amend and reenact R.S. 4:147.1(D), 183.2(A), and 217(D)(3) and R.S. 27:438(B)(5) and 3 to enact R.S. 27:361(B)(4)(d), relative to purse supplements; to provide for the 4 transferring and receiving of purse funds; to provide for the disposition of accrued 5 interest on undistributed monies at a race meeting; to provide for purse supplements 6 designation and distribution; to provide that purse supplements interest be used for 7 Louisiana bred races; to provide for the distribution of video draw poker device 8 revenues; and to provide for related matters. 9 Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 4:147.1(D), 183.2(A), and 217(D)(3) are hereby amended and 11 reenacted to read as follows: 12 §147.1. Commission; purse supplements; additional or substitute races and race 13 days; force majeure 14 * * * 15 D.(1) Notwithstanding any provision of law to the contrary and upon 16 agreement of the Horsemen's Benevolent and Protective Association and the 17 involved licensed eligible facilities transferring and receiving purse funds, the 18 commission may approve the transfer of slot machine proceeds received any purse 19 funds for thoroughbred race purses from one licensed eligible facility to another 20 licensed eligible facility to supplement thoroughbred purses at a thoroughbred race 21 meet. Funds transferred pursuant to this Paragraph shall be awarded within one year 22 of the date of transfer. HB NO. 932 ENROLLED 1 (2) Notwithstanding any provision of law to the contrary and upon 2 agreement of the Horsemen's Benevolent and Protective Association and the 3 involved licensed eligible facilities transferring and receiving purse funds, the 4 commission may approve the transfer of slot machine proceeds received any purse 5 funds for quarter horse race purses from one licensed eligible facility to another 6 licensed eligible facility to supplement quarter horse purses at a quarter horse race 7 meet. Funds transferred pursuant to this Paragraph shall be awarded within one year 8 of the date of transfer. 9 * * * 10 §183.2. Disposition of accrued interest on undistributed monies at a race meeting 11 A. Monies designated for purses under R.S. 4:183(A) shall be remitted to the 12 Horsemen's Benevolent and Protective Association within ten business days to be 13 deposited in a separate interest-bearing account when earned and shall remain in that 14 account until the first day of the next race meeting of the appropriate breed. Monies 15 earned as interest on that account shall be added to those designated for Louisiana 16 bred purses under R.S. 4:183(A) and shall be considered part of the gross purses as 17 defined therein. 18 * * * 19 §217. Purse supplements; designation and distribution 20 * * * 21 D. 22 * * * 23 (3) Monies designated for purse supplements under in accordance with this 24 Subsection that are not used during the current race meeting shall be placed in an 25 interest bearing account and shall remain in that account until the next licensed race 26 meeting held at the appropriate facility. At such time, the funds in that account and 27 the interest earned thereon shall then be used for purse supplements as provided 28 herein. HB NO. 932 ENROLLED 1 Section 2. R.S. 27:438(B)(5) is hereby amended and reenacted and R.S. 2 27:361(B)(4)(d) is hereby enacted to read as follows: 3 §361. Conduct of slot machine gaming; temporary conduct 4 * * * 5 B. As a condition of licensing and to maintain continued authority for the 6 conduct of slot machine gaming at the licensed eligible facility, the owner of the 7 licensed eligible facility shall: 8 * * * 9 (4) Contribute to the support of pari-mutuel wagering facilities in the state 10 at large and the horse breeding industry by paying annually from the annual net slot 11 machine proceeds received from slot machine gaming operations at the licensed 12 eligible facility as provided in this Paragraph: 13 * * * 14 (d) All interest earned on funds in this Section shall be used for only 15 Louisiana bred races. 16 * * * 17 §438. Distribution of video draw poker device revenues; particular licensed 18 establishments; pari-mutuel wagering facilities 19 * * * 20 B. Revenues earned for purse supplements under Subsection A of this 21 Section shall be disbursed, accounted for, and used as follows: 22 * * * 23 (5) Monies earned for purse supplements from video draw poker devices, 24 and interest earned on such monies, shall be added to all other monies currently 25 provided for purses and purse supplements under other provisions of law, and 26 distributed as follows: 27 (a) The purses and purse supplements for thoroughbred races shall be used 28 at the eligible facility's current live thoroughbred race meet, or if live thoroughbred 29 racing is not being conducted, used at the eligible facility's next live thoroughbred Page 3 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. All interest earned on purses and purse supplements in accordance with 2 this Section shall be for only Louisiana bred races. 3 (b) The purses and purse supplements for quarter horse races shall be used 4 at the eligible facility's current live quarter horse race meet, or if live quarter horse 5 racing is not being conducted, used at the eligible facility's next live quarter horse 6 race meet.
