HOUSE BILL NO. 958

INSURANCE/HEALTH:  Prohibits financial incentives or penalties to encourage healthcare
providers to administer vaccinations
1	AN ACT
2To enact R.S. 22:1008.1, relative to prohibited health insurance incentives; to prohibit the
3 payment of a financial reward to a healthcare provider to encourage vaccination; to
4 prohibit the denial of a claim or other penalties to encourage vaccination; to provide
5 for definitions; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 22:1008.1 is hereby enacted to read as follows: 
8 ยง1008.1.  Health coverage plans; vaccination; prohibited provider incentives
9	A.  A health coverage plan shall not pay or offer to pay to any healthcare
10 provider an incentive, bonus, or other amount beyond the contracted reimbursement
11 rate for a covered healthcare service with the intent to, directly or indirectly,
12 influence, persuade, or encourage the healthcare provider to administer any
13 vaccination.
14	B.  A health coverage plan shall not deny or otherwise refuse to reimburse
15 any claim for a covered healthcare service submitted by a healthcare provider or
16 impose any other penalty on a healthcare provider with the intent to, directly or
17 indirectly, influence, persuade, or encourage the healthcare provider to administer
18 any vaccination.
19	C.  For purposes of this Section, "health coverage plan" means any hospital,
20 health, or medical expense insurance policy, hospital or medical service contract,

1 employee welfare benefit plan, contract, or other agreement with a health
2 maintenance organization or a preferred provider organization, health and accident
3 insurance policy, or any other insurance contract of this type in this state, including
4 a group insurance plan, a self-insurance plan, and the Office of Group Benefits
5 programs.  "Health coverage plan" does not include a plan providing coverage for
6 excepted benefits as defined in R.S. 22:1061, limited benefit health insurance plans,
7 and short-term policies that have a term of less than twelve months.
