COURTS: Provides relative to justice of the peace courts and constables in Avoyelles

2To enact R.S. 13:2586(C)(7) and (8), relative to justice of the peace courts in Avoyelles
3 Parish and Evangeline Parish; to provide relative to jurisdiction and procedures; to
4 provide for jurisdiction over property standards and nuisance violations; to provide
5 relative to summons and subpoenas by constables; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 13:2586(C)(7) and (8) are hereby enacted to read as follows:

12 (7) A justice of the peace court in Avoyelles Parish shall have concurrent
13 jurisdiction over property standards and nuisance violations anywhere in the parish
14 in which the court is situated, pursuant to local ordinance. In addition, a constable
15 of a justice of the peace court in Avoyelles Parish may issue summons and serve
16 subpoenas for such violations occurring anywhere within the territorial jurisdiction
17 of the justice of the peace court.
18 (8) A justice of the peace court in Evangeline Parish shall have concurrent
19 jurisdiction over property standards and nuisance violations anywhere in the parish
20 in which the court is situated, pursuant to local ordinance. In addition, a constable

Abstract: Provides for the jurisdiction of justice of the peace courts in the parishes of
Avoyelles and Evangeline.
Present law provides that the justice of the peace courts in Caddo Parish shall have
concurrent jurisdiction with district courts over property standards violations in the district.
Provides further that a constable of a justice of a peace court in Caddo Parish may issue
summons and serve subpoenas for violations that occur in the district.
Present law provides that a constable of a justice of a peace court in St. Tammany Parish
may issue summons and serve subpoenas for violations that occur anywhere within St.
Tammany Parish for a property standards or nuisance violation. Provides further that the
justice of the peace courts in St. Tammany Parish shall have concurrent jurisdiction with
district courts over property standards and nuisance violations, with the exclusion of certain
wards.
Proposed law retains present law and provides that a justice of the peace court in Avoyelles
Parish shall have concurrent jurisdiction over property standards and nuisance violations
anywhere in the parish in which the court is situated. Provides further that a constable of a
justice of the peace court in Avoyelles Parish may issue summons and serve subpoenas for
such violations occurring anywhere within the territorial jurisdiction of the justice of the
peace court.
