R.S. 3:3810(A)(9) is hereby enacted to read as follows: 7 ยง3810. Violations 8 A. Failure to comply with any provision of this Chapter or of any rule or 9 regulation adopted pursuant to this Chapter shall constitute a violation. Proposed law provides that failure to obtain the insurance required for arborists as outlined in administrative rule LAC 7:XXIX.117(E)(2) constitutes a horticulture violation. Present law (R.S. 3:3810.2) provides the following civil penalties for horticulture violations: (1) $500 per violation, if the person was not found guilty in a prior adjudication. (2) $1000 per violation, if the person was found guilty in a prior adjudication. (3) $1,500 per violation, if the person was found guilty in two or more prior adjudications. (4) The commission may assess the costs of the adjudicatory hearing.
