HOUSE CONCURRENT RESOL UTION NO. 38
BY REPRESENTATIVE KERNER
CHILDREN/TUTORSHIP:  Requests the La. State Bar Association to work with
organizations providing legal aid to assist parents and guardians of children with
disabilities to obtain permanent tutorships
1	A CONCURRENT RESOL UTION
2To urge and request the Louisiana State Bar Association to raise awareness about permanent
3 tutorships and to work with legal aid organizations to help assist parents and
4 guardians of children with disabilities to obtain permanent tutorship.
5 WHEREAS, the Louisiana State Bar Association mission is to assist and serve its
6members in the practice of law, assure access to and aid in the administration of justice, and
7increase public understanding of and respect for the law; and 
8 WHEREAS, the Louisiana State Bar Association's mission is also to expand access
9to justice; and 
10 WHEREAS, the purpose of a legal aid organization is to help people who cannot
11afford to pay for representation; and
12 WHEREAS, parents have an interest in making decisions including educational,
13medical, and financial decisions for their child; and 
14 WHEREAS, a tutorship is the procedure to establish the legal responsibility of a
15person to care for a minor child through appointment by a court to be the child's tutor; and
16 WHEREAS, a tutorship can last past a child's eighteenth birthday if the court finds
17the child has a serious developmental disability; and
18 WHEREAS, persons, including certain children, with intellectual disabilities or
19mental deficiencies may be placed under a continuing or permanent tutorship without formal

1or complete interdiction in accordance with the rules and the procedures stated in the
2Louisiana Code of Civil Procedure; and
3 WHEREAS, parents or guardians of a child may not be able to afford legal
4representation to obtain a permanent tutorship.
5 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
6urge and request the Louisiana State Bar Association to raise awareness about permanent
7tutorships and work with legal aid organizations to assist parents and guardians of children
8with disabilities to obtain permanent tutorship.
9 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 
10Louisiana State Bar Association Board of Governors.
