HLS 24RS-2563 ORIGINAL 2024 Regular Session HOUSE RESOLUTION NO. 170 BY REPRESENTATIVE MANDIE LANDRY PARDON: Requests the House Committee on Administration of Criminal Justice, or a subcommittee thereof, to study the the current structure of the Board of Pardons 1 A RESOLUTION 2To urge and request the House Committee on Administration of Criminal Justice, or a 3 subcommittee thereof, to study the current structure of the Board of Pardons and 4 report its findings prior to the convening of 2025 Regular Session of the Legislature 5 of Louisiana. 6 WHEREAS, the Board of Pardons was established by the Constitution of Louisiana 7in 1916 and is currently located in Article IV, Section 5 of the Constitution of Louisiana of 81974; and 9 WHEREAS, the board consists of five electors appointed by the governor, who are 10subject to confirmation by the Senate, serve concurrent terms with the governor who 11appointed them, and all serve as members of the committee on parole; and 12 WHEREAS, members appointed by the governor are required to have at least five 13years of experience in the field of penology, corrections, law enforcement, sociology, law, 14education, social work, medicine, or a combination thereof, and are also required to 15complete a comprehensive orientation training program within ninety days of their 16appointment and eight hours of in-service training annually; and 17 WHEREAS, training components include but are not limited to the following: 18 (1) Elements of the decision-making process through the use of evidence-based 19practices for determining the risk, needs, and motivation to change. 20 (2) Dynamics of criminal victimization. 21 (3) Security classifications of people in prison or under community supervision; and Page 1 of 2 HLS 24RS-2563 ORIGINAL HR NO. 170 1 WHEREAS, the board's statutory powers and duties are located in Part I of Chapter 25 of Title 15 of the Louisiana Revised Statutes of 1950; and 3 WHEREAS, some of the board's duties include providing recommendations for 4pardons and commutation of sentences that are forwarded to the governor for final action; 5and 6 WHEREAS, assessing the former, current, and prospective structure of the board will 7assist with the administration of justice within the Louisiana criminal justice system. 8 THEREFORE, BE IT RESOLVED that the House of Representatives of the 9Legislature of Louisiana does hereby urge and request the House Committee on 10Administration of Criminal Justice, or a subcommittee thereof, to study the current structure 11of the Board of Pardons. 12 BE IT FURTHER RESOLVED that the House Committee on Administration of 13Criminal Justice shall report its findings to the House of Representatives prior to the 14convening of the 2025 Regular Session of the Legislature of Louisiana. 15 BE IT FURTHER RESOLVED that one print copy and one electronic copy of any 16report produced pursuant to this Resolution shall be submitted to the David R.
