HLS 24RS-2223 ENGROSSED 2024 Regular Session HOUSE RESOLUTION NO. 189 BY REPRESENTATIVE LYONS MEDICAID: Requests the Louisiana Department of Health to authorize certain nonemergency medical transportation providers to furnish services outside of their designated regions in particular circumstances 1 A RESOLUTION 2To urge and request the Louisiana Department of Health to allow nonemergency medical 3 transportation providers to serve Medicaid enrollees outside of their designated 4 regions if and when the enrollees need specialized nonemergency medical 5 transportation services. 6 WHEREAS, nonemergency, nonambulance medical transportation (NEMT) is a 7critical part of the Medicaid program and the provision of Medicaid services in this state; 8and 9 WHEREAS, NEMT services have contributed greatly to the overall health of 10Medicaid enrollees as they have allowed such persons access to primary care providers, 11pharmacy services, and other forms of healthcare services; and 12 WHEREAS, currently, there is concern for Medicaid enrollees with specialized 13medical needs who live outside of the nonemergency medical transportation service regions; 14and 15 WHEREAS, such persons are unable to access the treatments they need; and 16 WHEREAS, for enrollees, NEMT provider services are not readily available through 17a provider in every enrollee's region; and 18 WHEREAS, by allowing Medicaid enrollees with specialized medical needs access 19to NEMT services, even when they are out of region, the Louisiana Department of Health 20can address this concern; and Page 1 of 2 HLS 24RS-2223 ENGROSSED HR NO. 189 1 WHEREAS, the allowance of out-of-region NEMT provider services could benefit 2Medicaid enrollees with specialty medical needs and improve the overall efficacy of the 3NEMT program and the healthcare system statewide; and 4 WHEREAS, the Louisiana Department of Health, Medicaid managed care 5organizations, and the respective patient health plans shall determine which providers are 6the best candidates to accommodate those enrollees who are in need of out-of-region NEMT 7provider services. 8 THEREFORE, BE IT RESOLVED that the House of Representatives of the 9Legislature of Louisiana does hereby urge and request the Louisiana Department of Health 10to allow nonemergency medical transportation providers to serve Medicaid enrollees outside 11of their designated regions if and when the enrollees with specialized medical needs are in 12need of access to NEMT provider services. 13 BE IT FURTHER RESOLVED that the Louisiana Department of Health, Medicaid 14managed care organizations, and the respective patient health plans shall be tasked with 15authorizing providers to serve out-of-region enrollees to remedy some of the issues where 16such special conditions exist. 17 BE IT FURTHER RESOLVED that authorized NEMT service providers should be 18determined based on patient acuity and equipment availability. 19 BE IT FURTHER RESOLVED that the Louisiana Department of Health is hereby 20authorized to promulgate administrative rules as necessary to implement the provisions of 21this Resolution. 22 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 23secretary of the Louisiana Department of Health and the director of the Louisiana Managed 24Medicaid Association.
