SENATE BILL NO. 102

PORTS/HARBORS/TERMINALS. Provides for policing of the Port of Delcambre, Twin
Parish Port District. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 34:1603.2(A), (D), and (E), relative to port and harbor police;
3 to provide for removing provisions based on population; to provide for an effective
4 date; and to provide for related matters.
5	Notice of intention to introduce this Act has been published.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 34:1603.2(A), (D), and (E) are hereby amended and reenacted to read
8 as follows:
9 ยง1603.2. Port and harbor police
10	A. For purposes of this Section, the board of commissioners for any port
11 district whose territory includes a parish with a population of sixty-eight thousand
12 to seventy-three thousand according to the latest federal decennial census and a
13 parish with a population of fifty-seven thousand to fifty-seven thousand four hundred
14 according to the latest federal decennial census The board may, in its discretion,
15 appoint, fix salaries of, and pay port and harbor police. The port and harbor police
16 may consist of any number of people of good character and citizens of the state who
17 have completed a course certified by the Council on Peace Officer Standards and

1 Training; however, no member shall be under eighteen years of age.

3	D. Any persons arrested by officers of the commission meeting the
4 requirements of Subsection A of this Section and the return of all warrants or
5 processes served by these officers shall be surrendered or delivered to the criminal
6 sheriff of the parish in which the arrest occurred as determined by location of arrest;
7 provided this shall in no way deprive the sheriff or deputy sheriff in a parish with a
8 population of sixty-eight thousand to seventy-three thousand or fifty-seven thousand
9 to fifty-seven thousand four hundred the parishes of Iberia and Vermilion from
10 making arrests or from serving warrants or process of court in any such place or on
11 any such premises.
12	E. A commission that meets the requirements of Subsection A of this Section
13 The board shall adopt rules and regulations for the conduct, management, and
14 control of the port and harbor police, and shall, from time to time, enlarge, modify,
15 or change such rules and regulations in its discretion.
19 Section 2. This Act shall become effective upon signature by the governor or, if not
20 signed by the governor, upon expiration of the time for bills to become law without signature
21 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
22 vetoed by the governor and subsequently approved by the legislature, this Act shall become
23 effective on the day following such approval.

Present law specifies that a board of commissioners for a port in parishes which have a
population of 68,000 to 73,000 and 57,000 to 57,400, respectively as determined by the
latest federal decennial census may appoint, fix salaries of, and pay port and harbor police
who have completed a course certified by the Council on Peace Officer Standards and
Training to perform law enforcement duties commensurate with powers of sheriffs. Present
law further allows a commission of a port in a designated population to adopt rules and
regulations for the conduct, management, and control of the port and harbor police, and
shall, from time to time, enlarge, modify, or change such rules and regulations in its
discretion.
Proposed law retains present law but removes the population designation.

Present law provides for arrestees of the port and harbor police to be delivered to the sheriff
of the parish in which the arrest occurs, and provides that such authority does not deprive
law enforcement from a parish with a population of 68,000 to 73,000 or 57,000 to 57,400,
according to the latest federal decennial census, from performing their duties.
Proposed law retains present law but removes the population designation and identifies the
parishes of Iberia and Vermilion.
Effective upon signature of the governor or lapse of time for gubernatorial action.
