2024 Regular Session ENROLLED SENATE BILL NO. 102 BY SENATOR MIGUEZ 1 AN ACT 2 To amend and reenact R.S. 34:1603.2(A), (D), and (E), relative to port and harbor police; 3 to provide for removing provisions based on population; to provide for an effective 4 date; and to provide for related matters. 5 Notice of intention to introduce this Act has been published. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 34:1603.2(A), (D), and (E) are hereby amended and reenacted to read 8 as follows: 9 ยง1603.2. Port and harbor police 10 A. For purposes of this Section, the board of commissioners for any port 11 district whose territory includes a parish with a population of sixty-eight thousand 12 to seventy-three thousand according to the latest federal decennial census and a 13 parish with a population of fifty-seven thousand to fifty-seven thousand four hundred 14 according to the latest federal decennial census The board may, in its discretion, 15 appoint, fix salaries of, and pay port and harbor police. The port and harbor police 16 may consist of any number of people of good character and citizens of the state who 17 have completed a course certified by the Council on Peace Officer Standards and 18 Training; however, no member shall be under eighteen years of age. 19 * * * 20 D. Any persons arrested by officers of the commission meeting the 21 requirements of Subsection A of this Section and the return of all warrants or 22 processes served by these officers shall be surrendered or delivered to the criminal 23 sheriff of the parish in which the arrest occurred as determined by location of arrest; 24 provided this shall in no way deprive the sheriff or deputy sheriff in a parish with a 25 population of sixty-eight thousand to seventy-three thousand or fifty-seven thousand 26 to fifty-seven thousand four hundred the parishes of Iberia and Vermilion from 27 making arrests or from serving warrants or process of court in any such place or on Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. A commission that meets the requirements of Subsection A of this Section 3 The board shall adopt rules and regulations for the conduct, management, and 4 control of the port and harbor police, and shall, from time to time, enlarge, modify, 5 or change such rules and regulations in its discretion. 6 Section 2. This Act shall become effective upon signature by the governor or, if not 7 signed by the governor, upon expiration of the time for bills to become law without signature 8 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 9 vetoed by the governor and subsequently approved by the legislature, this Act shall become 10 effective on the day following such approval.
