SENATE BILL NO. 132

CRIME/PUNISHMENT. Provides relative to the penalties for illegal carrying of a firearn
at a parade.  (8/1/24)
1	AN ACT
2 To amend and reenact R.S. 14:95.2.1(A), relative to the crime of illegal carrying of a firearm
3 at a parade; to provide relative to penalties; to require that the first year of any
4 sentence of imprisonment be served without benefit of parole, probation, or
5 suspension of sentence; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 14:95.2.1(A) is hereby amended and reenacted to read as follows:
8 ยง95.2.1. Illegal carrying of a firearm at a parade with any firearm used in the
9	commission of a crime of violence
10	A.(1) Whoever commits the crime of illegal carrying of weapons pursuant to
11 R.S. 14:95 with any firearm used in the commission of a crime of violence as defined
12 in R.S. 14:2(B), within one thousand feet of any parade or demonstration for which
13 a permit is issued by a governmental entity, shall be fined not more than two
14 thousand dollars, or imprisoned, with or without hard labor, for not less than one
15 year nor more than five years, or both. The first year of any sentence of
16 imprisonment shall be served without benefit of parole, probation, or
17 suspension of sentence.

1	(2) Any sentence issued pursuant to the provisions of this Subsection and any
2 sentence issued pursuant to a violation of a crime of violence as defined in R.S.
3 14:2(B) shall be served consecutively.

Present law defines and provides relative to the crime of illegal carrying of weapons. 
Proposed law retains present law. 
Present law provides that whoever commits the crime of illegal carrying of weapons with
a firearm used in the commission of a crime of violence within 1,000 feet of any parade or
demonstration for which a permit is issued by a governmental entity will be fined up to
$2,000 or imprisoned, with or without hard labor, for between one year and five years, or
both.
Proposed law requires that the first year of any sentence of imprisonment be served without
benefit of parole, probation, or suspension of sentence and otherwise retains present law.
Present law provides that any sentence issued pursuant to present law and any sentence
issued pursuant to a violation of a crime of violence will be served consecutively.
Proposed law retains present law. 
Effective August 1, 2024.
