(8/1/24) 1 AN ACT 2 To amend and reenact R.S. 14:108.1(E), relative to offenses affecting law enforcement; to 3 provide relative to the crime of aggravated flight from an officer; to increase the 4 penalties for aggravated flight from an officer; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 14:108.1(E) is hereby amended and reenacted to read as follows: 7 ยง108.1. Clement Jr. DIGEST SB 184 Original 2024 Regular Session Kleinpeter Present law defines aggravated flight from an officer as the intentional refusal of a driver to bring a vehicle to a stop or of an operator to bring a watercraft to a stop, under circumstances wherein human life is endangered, knowing that he has been given a visual and audible signal to stop by a police officer when the officer has reasonable grounds to believe that the driver or operator has committed an offense. Proposed law retains present law. Present law provides that aggravated flight from an officer is punishable by imprisonment at hard labor for up to five years and in addition a possible fine of up to $2,000. Proposed law increases the maximum period of imprisonment from five years to ten years and otherwise retains present law. Present law provides that aggravated flight from an officer when the offense results in serious bodily injury is punishable by imprisonment at hard labor for up to ten years and in addition a possible fine of up to $2,000. Proposed law increases the maximum period of imprisonment when serious bodily injury occurs from ten years to 15 years and otherwise retains present law. Effective August 1, 2024.
