SLS 24RS-474 ORIGINAL 2024 Regular Session SENATE BILL NO. 187 BY SENATOR BOUDREAUX MEDICAID. Creates a pilot program for Medicaid recipients to utilize portable oxygen concentrators. (8/1/24) 1 AN ACT 2 To enact R.S. 46:460.76.1, relative to a pilot program for Medicaid recipients to utilize 3 portable oxygen concentrators; to provide for a pilot program developed by the 4 Louisiana Department of Health; to provide for creation of a fund; and to provide for 5 related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 46:460.76.1 is hereby enacted to read as follows: 8 ยง460.76.1. Medicaid pilot program; portable oxygen concentrator; fund 9 A. The legislature finds that portable oxygen concentrators are not 10 currently covered under the Louisiana Medicaid fee schedule, but could 11 improve quality of life for many Louisiana residents. 12 B. The Louisiana Department of Health shall establish a pilot program 13 in one or more of the nine department administrative regions to provide 14 adequate funding for Louisiana Medicaid recipients to utilize portable oxygen 15 concentrators if prescribed by a licensed physician. 16 C.(1) There is hereby created in the state treasury a special fund to be 17 known as the Medicaid Portable Oxygen Concentrator Fund, hereinafter Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. Monies in the fund shall be used exclusively to fund 2 portable oxygen concentrators for Medicaid recipients who have a prescription 3 by a licensed physician. The Department of Health shall develop regulations and 4 guidelines for the distribution and allocation of any monies appropriated to the 5 department pursuant to this Section. 6 (2) The sources of monies deposited into the fund shall be any funds 7 appropriated by the legislature and any grants, gifts, or donations received by 8 the state for the purposes of this Section. 9 (3) Monies in the fund shall be invested in the same manner as the state 10 general fund monies. Interest earned on the investment of monies in the fund, 11 after being credited to the Bond Security and Redemption Fund pursuant to 12 Article VII, Section 9(B) of the Constitution of Louisiana, shall be credited to 13 the fund. All unexpended and unencumbered monies and earnings remaining 14 in the fund at the end of the fiscal year shall remain in the fund and shall be 15 available for allocation in the next fiscal year in the same manner and for the 16 same purposes as provided in this Section. Proposed law establishes the Medicaid Portable Oxygen Concentrator Fund to help cover the costs of this benefit. Effective August 1, 2024.
