SLS 24RS-423 ORIGINAL 2024 Regular Session SENATE BILL NO. 233 BY SENATOR MIGUEZ WEAPONS. Provides for the carrying of concealed firearms by qualified law enforcement officers and qualified retired law enforcement officers. (8/1/24) 1 AN ACT 2 To enact R.S. 40:1379.1.3(D) and 1379.1.4(F), relative to carrying of concealed firearms; 3 to provide relative to carrying of concealed firearms by qualified law enforcement 4 officers and qualified retired law enforcement officers; to provide relative to 5 penalties for violation of concealed carry provisions; to provide relative to authority 6 of attorney general to bring civil actions; and to provide for related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 40:1379.1.3(D) and 1379.1.4(F) are hereby enacted to read as 9 follows: 10 §1379.1.3. Carrying of concealed firearms by qualified law enforcement officers 11 * * * 12 D. A business organization operating a venue shall be subject to a civil 13 fine of one thousand dollars per occurrence for each violation of the provisions 14 of this Section. Each violation of this Section shall constitute a separate offense. 15 The attorney general shall have the authority to bring a civil action arising out 16 of any violation of the provisions of this Section, in addition to any other 17 authority granted by the Constitution of Louisiana and laws of this state. DIGEST SB 233 Original 2024 Regular Session Miguez Present law (R.S. 40:1379.1.3) permits an individual who is a qualified law enforcement officer to carry a concealed firearm anywhere in the state, including any place open to the public, if he meets certain eligibility criteria. Present law (R.S. 40:1379.1.4) permits an individual who is a qualified retired law enforcement officer to carry a concealed firearm anywhere in the state, including any place open to the public, if he meets certain eligibility criteria. Proposed law retains present law and provides that a business organization operating a venue shall be subject to a civil fine of $1,000 per occurrence for each violation of the provisions of present law, permitting a qualified law enforcement officer or a qualified retired law enforcement officer to carry a concealed firearm. Proposed law provides that the attorney general shall have the authority to bring a civil action arising out of any violation of the provisions of proposed law, in addition to any other authority granted by the Constitution and laws of this state.
