Provides relative to board members and qualifications of the State Board of Examiners of Interior Designers. (8/1/24) 1 AN ACT 2 To amend and reenact R.S. 37:3173, relative to interior designers; to provide for board 3 members; to provide for terms of office of the members of the board; to provide for 4 board member qualifications; to provide for vacancies on the board; to provide for 5 terms and conditions; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 37:3173 is hereby amended and reenacted to read as follows: 8 ยง3173. State Board of Examiners of Interior Designers; creation; qualifications; 9 appointment 10 A.(1) There is hereby created the State Board of Examiners of Interior 11 Designers within the office of the governor consisting of seven members appointed 12 by the governor from a list of names of qualified candidates submitted by the 13 board as follows: 14 (a) Six members shall be registered interior designers. 15 (b) One member selected from the public at-large. 16 (2) Each appointment shall be submitted to the Senate for confirmation. Each 17 member shall be a registered interior designer and a citizen of Louisiana. SB NO. 257 SLS 24RS-140 ENGROSSED 1 (3)(a) Upon expiration of the terms of the members in office on January 1, 2 2000, the terms of members shall be for a period of four years or until the members' 3 successors have been appointed and have taken office. 4 (b) Notwithstanding the provisions of Subparagraph (a) of this Paragraph, the 5 seven appointed members who are the successors to those members whose terms 6 expired at noon on January 1, 2004, shall serve for the following terms as designated 7 by the governor: 8 (i) One member appointed from the list submitted by the American Society 9 of Interior Designers shall serve a two-year term, the other shall serve a three-year 10 term, and the other shall serve a four-year term. 11 (ii) One member appointed from the list submitted by registered interior 12 designers whose registrations are in good standing shall serve a two-year term, the 13 other shall serve a three-year term. 14 (iii) One member appointed from a list submitted by the International Interior 15 Design Association shall serve a three-year term. 16 (iv) One member appointed from a list submitted by the Interior Design 17 Educators Counsel, Inc. shall serve a four-year term. 18 (v) Thereafter, all successive appointed members shall serve four-year terms 19 as provided in Subparagraph (A)(3)(a) of this Section. 20 B.(1) Three members of the board shall be selected from a list of nine names 21 from its membership submitted by the American Society of Interior Designers. 22 (2) Two members shall be selected from the list of licensed or registered 23 interior designers whose licenses are in good standing at the time of the appointment. 24 (3) One member shall be selected from a list of three names from its 25 membership submitted by the International Interior Design Association. 26 (4) One member shall be an interior design educator selected from a list of 27 three names submitted by the Interior Design Educators Counsel, Inc. 28 Each member shall hold the following qualifications: 29 (1) Each registered interior designer member shall: Page 2 of 4 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 257 SLS 24RS-140 ENGROSSED 1 (a) Be an interior designer registered in the state whose registration is in 2 good standing. 3 (b) Be a resident of the state. 4 (c) Possess a National Council for Interior Designer Qualification 5 certificate. 6 (d) Have provided interior design services as a registered interior 7 designer for at least five years prior to appointment to the board. 8 (2) The public member shall represent the health, safety, and welfare of 9 consumers of the state and shall: 10 (a) Be a resident of the state. 11 (b) Not be an immediate family member as defined in the Code of 12 Governmental Ethics, R.S. 42:1101 et seq., of any registered interior designer. 13 C. The term of each member of the board shall be for a period of four 14 years or until a member's successor has been appointed and taken office. 15 D. Each vacancy shall be filled in the manner of original appointment except 16 that a list of names shall be submitted for each vacancy arising under the categories 17 designated under Paragraphs (1) and (2) of Subsection B of this Section. 18 D. E. Prior to entering upon the discharge of his duties, each member of the 19 board shall subscribe to and file with the secretary of state the constitutional oath of 20 office. 21 E. F. The board shall select annually from among its members a chairman 22 and such other officers as it deems necessary. 23 F. G. Four members of the board shall constitute a quorum for the transaction 24 of business, but no action shall be taken without at least four votes in accord. Proposed law maintains a seven member board. Present law provides that the seven member board shall consist of the following: (1)Three members of the board shall be selected from a list of nine names from its membership submitted by the American Society of Interior Designers. (2)Two members shall be selected from the list of licensed or registered interior designers whose licenses are in good standing at the time of appointment. (3)One member shall be selected from a list of three names from its membership submitted by the International Interior Design Association. (4)One member shall be an interior design educator selected from a list of three names submitted by the Interior Design Educators Counsel, Inc. Proposed law deletes present law as it relates to the selection of members and provides that the seven member board shall consist of six registered interior designers and one member selected from the public appointed by the governor from a list of names of qualified candidates submitted by the board. Proposed law requires that the six registered interior designers appointed to the board shall be in good standing with the board, reside in the state, possess a NCIDQ certification, and have provided interior design services as a registered interior designer for at least five years prior to being appointed to the board. Proposed law requires that the one member from the public appointed to the board shall represent the health, safety and welfare of consumers in the state and be a resident in the state and shall not be an immediate family member of any registered interior designer. Proposed law provides that the terms for all members of the board shall be for a period of four years or until members' successors have been appointed and have taken office. Proposed law provides the procedure to fill board member vacancies. Effective August 1, 2024.
