SENATE BILL NO. 329

CIVIL PROCEDURE. Provides relative to venue for certain legal actions instituted by the
Municipal Police Employees' Retirement System. (8/1/24)
1 AN ACT
2 To amend and reenact Code of Civil Procedure Art. 84 and to enact Code of Civil Procedure
3 Art. 84.1, relative to venue; to provide relative to proper venue for actions involving
4 the Municipal Police Employees' Retirement System; and to provide for related
5 matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. Code of Civil Procedure Art. 84 is hereby amended and reenacted and
8 Code of Civil Procedure Art. 84.1 is hereby enacted to read as follows:
9 Art. 84. Action involving certain retirement systems and employee benefit programs
10 Actions involving the Louisiana State Employees' Retirement System, Office
11 of Group Benefits, State Police Pension and Relief Fund, Louisiana School
12 Employees' Retirement System, Louisiana School Lunch Employees' Retirement
13 System, Teachers' Retirement System of Louisiana, Assessors' Retirement Fund,
14 Clerks of Court Retirement and Relief Fund, District Attorneys' Retirement System,
15 Municipal Employees' Retirement System of Louisiana, Parochial Employees'
16 Retirement System of Louisiana, Registrar of Voters Employees' Retirement System,
17 Sheriffs' Pension and Relief Fund, Municipal Police Employees' Retirement System,

1 or the Firefighters' Retirement System shall be brought in the parish of East Baton
2 Rouge or in the parish of the domicile of the retirement system or employee benefit
3 program.
4 Art. 84.1. Actions involving the Municipal Police Employees' Retirement
5 System
6 Notwithstanding any provision of law to the contrary, any action
7 involving the Municipal Police Employees' Retirement System or its board of
8 trustees shall be instituted before the district court of the judicial district in
9 which the employer is located.

Present law provides that actions involving the Municipal Police Employees' Retirement
System shall be brought in the parish of East Baton Rouge or in the parish of the domicile
of the retirement system or employee benefit program.
Proposed law provides that actions involving the Municipal Police Employees' Retirement
System shall be instituted before the district court of the judicial district in which the
employer is located.
Effective August 1, 2024.
