2024 Regular Session ENROLLED SENATE BILL NO. 384 BY SENATOR FIELDS 1 AN ACT 2 To amend and reenact R.S. 18:1315(C)(3)(a) and 1317, relative to certain voter data; to 3 provide for reporting requirements; to provide for dissemination of information by 4 the secretary of state; to provide for an effective date; and to provide for related 5 matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 18:1315(C)(3)(a) and 1317 are hereby amended and reenacted to read 8 as follows: 9 §1315. Challenge of absentee by mail or early voting ballot 10 * * * 11 C. 12 * * * 13 (3)(a) If a challenge in accordance with the provisions of Subsection B of this 14 Section is sustained, the vote shall not be counted and the board shall write 15 "rejected" and the cause therefor across the ballot envelope or early voting 16 confirmation sheet, and shall place the ballots and early voting confirmation sheets 17 so rejected in the special, secure absentee by mail and early voting ballot container. 18 The board shall notify the voter in writing of the challenge and the cause therefor. 19 The notification shall be on a form provided by the secretary of state and shall be 20 signed by at least a majority of the members of the board. The notice of the challenge 21 and the cause therefor shall be given within four business days by mail addressed to 22 the voter at his place of residence. The board shall retain a copy of the notification. 23 The registrar shall record the reason for the rejection in the state voter 24 registration computer system. 25 * * * 26 §1317. SB NO. 384 ENROLLED 1 The secretary of state shall promulgate and adopt rules as necessary to 2 effectuate uniform and standardized processes for the review and curing or rejection 3 of deficient absentee by mail ballots by the parish board of election supervisors, 4 shall maintain records of all ballots rejected pursuant to the provisions of R.S. 5 18:1315(C)(3)(a), and shall include information detailing the total number of 6 ballots rejected per parish and the reasons for their rejection in the post- 7 election statistical data published to the website of the secretary of state. 8 Section 2. This Act shall become effective on July 1, 2025.
