SENATE BILL NO. 441
BY SENATOR HARRIS AND REPRESENTATIVES CHASSION, DEWITT, MACK,
ORGERON AND ZERINGUE 
1	AN ACT
2 To amend and reenact Section 2 and Section 3 of Act No. 57 of the 2021 Regular Session
3 of the Legislature; to provide for the transfer of certain state property; to provide for
4 the authority to transfer certain state property in Orleans Parish; to provide an
5 effective date; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. Section 2 and Section 3 of Act No. 57 of the 2021 Regular Session of the
8 Legislature are hereby amended and reenacted to read as follows:
9 Section 2. The president of the University of Louisiana System, as authorized by the
10 Board of Supervisors for the University of Louisiana System, and the commissioner of
11 administration are hereby authorized to enter into such agreements, covenants, conditions,
12 and stipulations and to execute such documents as necessary to properly effectuate any
13 conveyance, transfer, assignment, or delivery of title, including any agreement allowing
14 for the conveyance, transfer, assignment, or delivery of title as an installment purchase
15 over multiple years, excluding mineral rights, to the property described in Section 1 of this
16 Act, and as more specifically described in any such agreements entered into and documents
17 executed by and between the president of the University of Louisiana System, the
18 commissioner, and The Ogden Museum of Southern Art, Inc., in exchange for appropriate
19 consideration sufficient to satisfy the provisions of Article VII, Section 14(A) of the
20 Constitution of Louisiana. For purposes of determining appropriate consideration for
21 this transaction, The Ogden Museum of Southern Art, Inc., shall be credited for any
22 maintenance, upkeep, repairs, capital contributions, or any other expenditures made
23 that benefit the property described in Section 1 of this Act.
24 Section 3. (a) Notwithstanding any other provision of law to the contrary, any
25 and all proceeds from the sale of the property described in Section 1 of this Act shall
26 be credited to the University of New Orleans to be used at its sole discretion.

1	(b) The authorities granted by this Act shall terminate on June 30, 2024 2028.
2 Section 4. This Act shall become effective upon signature by the governor or, if not
3 signed by the governor, upon expiration of the time for bills to become law without signature
4 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
5 vetoed by the governor and subsequently approved by the legislature, this Act shall become
6 effective on the day following such approval.
