SLS 24RS-824 ORIGINAL 2024 Regular Session SENATE BILL NO. 455 BY SENATOR BARROW HEALTH SERVICES. Restricts the location of certain psychiatric facilities. (gov sig) 1 AN ACT 2 To enact R.S. 28:26, relative to the location of psychiatric facilities; to prohibit certain 3 psychiatric facilities from being located in certain areas; to provide for requirements 4 imposed by local governing authorities; to provide for an effective date; and to 5 provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 28:26 is hereby enacted to read as follows: 8 ยง26. Psychiatric facility; forensic facility; prohibitions 9 A. No psychiatric hospital, psychiatric residential treatment facility, 10 forensic treatment facility, forensic supervised transitional residential and 11 aftercare facility, or any other facility where forensic health services are 12 provided to adults on an inpatient basis shall be purchased, constructed, 13 located, established, enlarged, or changed in character by the type or 14 classification of patients in the facility within one-half mile of any of the 15 following: 16 (1) Public or private elementary or secondary school. 17 (2) Early learning center as defined by R.S. 17:407.33. SB NO. 455 SLS 24RS-824 ORIGINAL 1 (3) Residence in which child care services are provided by a family child- 2 care provider or in-home provider who is registered pursuant to R.S. 17:407.61 3 et seq. 4 (4) Residential area that has been zoned or designated as such by the 5 appropriate local governing authority. 6 (5) Public park. 7 B. Nothing in this Section shall be construed to prohibit a local governing 8 authority from prescribing by rule or ordinance any additional requirements 9 for facilities provided for in Subsection A of this Section. 10 Section 2. This Act shall become effective upon signature by the governor or, if not 11 signed by the governor, upon expiration of the time for bills to become law without signature 12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 13 vetoed by the governor and subsequently approved by the legislature, this Act shall become 14 effective on the day following such approval. Proposed law authorizes a local governing authority to establish additional requirements for the psychiatric facilities in proposed law. Effective upon signature of the governor or lapse of time for gubernatorial action.
