SENATE BILL NO. 462

APPOINTED OFFICIALS. Provides for gubernatorial appointments. (gov sig)
1	AN ACT
2 To enact R.S. 42:4(C), relative to gubernatorial appointments; to provide for appointments
3 of certain members to certain boards and commissions; to provide for appointee
4 qualifications and terms; to provide for notice requirements; to provide for Senate
5 confirmation of appointees; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 42:4(C) is hereby enacted to read as follows: 
8 ยง4. Public officers appointed by the Governor

10	C. (1) Notwithstanding any provision of law to the contrary, the governor
11 may elect to appoint the chairman, or any other officer, of each board and
12 commission whose appointment is not otherwise provided for in the
13 Constitution of Louisiana.
14	(2)(a) Within twenty days of taking office, the governor shall notify each
15 board and commission for which he has elected to appoint the chairman or any
16 other officer that he has elected to do so.
17	(b) If the governor fails to notify any board or commission within twenty

1 days of taking office that he has elected to appoint the chairman, or any other
2 officer, then the election of the chairman or officer shall occur as provided by
3 law, rule, or regulation promulgated by the board or commission.
4	(3) If the governor elects to appoint the chairman, or any other officer,
5 he shall do so no later than the first day of the first regular session of the
6 Legislature of Louisiana during the first year of his term of office as governor.
7	(4) An appointment made by the governor pursuant to this Subsection
8 shall be made from the membership of the board or commission.
9	(5) The governor shall submit for confirmation by the Senate the name
10 of any appointee to a board or commission made pursuant to this Subsection.
11	(6) Any board or commission chairman or other officer appointed by the
12 governor and confirmed by the Senate pursuant to this Subsection shall serve
13 at the pleasure of the governor in the position for which the appointment is
14 made under this Subsection.
15 Section 2. For terms of office beginning January 8, 2024, any election or appointment
16 made pursuant to the provisions of this Act shall occur not later than August 1, 2024.
17 Section 3. This Act shall become effective upon signature by the governor or, if not
18 signed by the governor, upon expiration of the time for bills to become law without signature
19 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
20 vetoed by the governor and subsequently approved by the legislature, this Act shall become
21 effective on the day following such approval.

governor may elect to appoint the chairman, or any other officer, of each board and
commission whose appointment is not otherwise provided for in present constitution.
Proposed law provides that the governor must notify each board and commission for which
he has elected to appoint the chairman or any other officer of his intentions within 20 days
of taking office and that the governor must make the appointment no later than the first day
of the first regular session of the legislature during the first year of his term.

Proposed law provides that if the governor fails to notify any board or commission within
20 days of taking office that he has elected to appoint the chairman or any other officer then
the election of the chairman or other officer will take place as provided by present law or
rule or regulation promulgated by the board or commission.
Proposed law provides that any appointment made by the governor pursuant to proposed law
must be from the membership of the board or commission and is subject to Senate
confirmation.
Proposed law provides that any gubernatorial appointment made pursuant to proposed law
and confirmed by the Senate will serve at the pleasure of the governor in the position to
which appointed.
Proposed law provides that for the gubernatorial term of office beginning January 8, 2024,
any election or appointment made pursuant to proposed law must be made no later than
August 1, 2024.
Effective upon signature of the governor or lapse of time for gubernatorial action.
