Present law provides that criminal trespass occurs when a person enters or remains on
immovable property, or in a structure, watercraft, or movable owned by another without
express, legal, or implied authorization.
Present law provides that "occupant", as defined by other present law, must vacate
immovable property within five days of receiving written notice.
Proposed law provides that the owner of immovable property must obtain a judgment of
eviction to remove an occupant. Proposed law applies the crime of criminal trespass to an
occupant who fails to vacate immovable property within five days of being served with a
judgement of eviction.
Proposed law otherwise retains present law.
