SENATE BILL NO. 93

ROADS/HIGHWAYS. Prohibits commercial motor vehicles from driving on Louisiana
Highway 1019 between Louisiana Highway 16 and Louisiana Highway 64. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 32:261, relative to use of highways; to prohibit the use of certain
3 highways; to provide for rulemaking and signage by the department of transportation
4 and development; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 32:261 is hereby amended and reenacted to read as follows: 
7 ยง261. Authority to prohibit use of road
8	A. The department may prohibit the operation of vehicles upon any highway
9 of this state or impose restrictions as to the weight of vehicles to be operated upon
10 any highway whenever any such highway, because of its substandard condition or
11 because of deterioration, rain, snow, or other climatic conditions, or construction
12 thereof, or because of traffic conditions thereon, will be seriously damaged or
13 destroyed, or the public endangered by the use of vehicles thereon unless such use
14 is prohibited or the permissible weights thereof reduced.
15	B. (1) The department shall prohibit the operation of commercial motor
16 vehicles, freight carriers, and vehicles in excess of the weight restrictions
17 established by the department on Louisiana Highway 1019, between Louisiana

1 Highway 16 and Louisiana Highway 64 until the highway is constructed to
2 withstand the weight of the restricted vehicles.
3	(2) The Department of Transportation and Development is hereby
4 directed to erect and maintain appropriate signs of the restrictions imposed by
5 this Subsection.
6 Section 2. This Act shall become effective upon signature by the governor or, if not
7 signed by the governor, upon expiration of the time for bills to become law without signature
8 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
9 vetoed by the governor and subsequently approved by the legislature, this Act shall become
10 effective on the day following such approval.

Present law provides the Department of Transportation and Development may prohibit the
operation of vehicles upon any highway of this state or impose restrictions as to the weight
of vehicles because of substandard condition or because of climatic conditions.
Proposed law directs the Department to impose weight limit restrictions on certain vehicles
on La. Hwy 1019.
Effective upon signature of the governor or lapse of time for gubernatorial action.
