Establishes a task force to review the governance of community-based residential settings. 1 A RESOLUTION 2 To establish and provide for the Task Force on the Regulation of Community-Based 3 Residential Settings. 4 WHEREAS, in 2018, the Senate formed a task force to study and make 5 recommendations relative to current and proposed regulations of community-based 6 residential settings; and 7 WHEREAS, the Task Force on Prevention of Human Degradation and Exploitation 8 of Vulnerable Individuals in Community-Based Residential Settings was initially created by 9 Senate Resolution No. 23 of the 2018 Second Extraordinary Session, continued and 10 otherwise provided for by Senate Resolution No. 203 of the 2019 Regular Session of the 11 Legislature, recreated by Senate Resolution No. 52 of the 2020 Second Extraordinary 12 Session of the Legislature, and continued by Senate Resolution No. 120 of the 2021 Regular 13 Session, Senate Resolution No. 217 of the 2022 Regular Session of the Legislature, and 14 Senate Resolution No. 149 of the 2023 Regular Session of the Legislature. 15 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana 16 does hereby establish and provide for the Task Force on the Regulation of Community- 17 Based Residential Settings to fulfill the mission originally assigned to the Task Force on 18 Prevention of Human Degradation and Exploitation of Vulnerable Individuals in Page 1 of 5 SR NO. 169 SLS 24RS-4440 ORIGINAL 1 Community-Based Residential Settings. 2 BE IT FURTHER RESOLVED that the task force shall meet as often as is necessary 3 to fulfill its mission and to submit a report, including any legislative proposals, to the Senate 4 and to the David R. Poynter Legislative Research Library as required by R.S. 24:771 and 5 772, no later than March 1, 2025. 6 BE IT FURTHER RESOLVED that the task force shall consist of the following 7 members: 8 (1) The secretary of the Louisiana Department of Health, or his designee. 9 (2) The state health officer, or his designee. 10 (3) The director of the health standards section within the Louisiana Department of 11 Health, or his designee. 12 (4) The director of the adult protective services section within the Louisiana 13 Department of Health, or his designee. 14 (5) The secretary of the Department of Children and Family Services, or his 15 designee. 16 (6) The attorney general, or his designee. 17 (7) The state fire marshal, or his designee. 18 (8) The executive director of the Louisiana Municipal Association, or his designee. 19 (9) The executive director of the Police Jury Association of Louisiana, or his 20 designee. 21 (10) The executive director of the Advocacy Center of Louisiana, or his designee. 22 (11) The executive director of the Louisiana Sheriffs' Association, or his designee. 23 (12) The executive director of the Louisiana District Attorneys Association, or his 24 designee. 25 (13) One person appointed by the chairman of the Senate Committee on Health and 26 Welfare. 27 (14) One person appointed by the chairman of the Senate Committee on Judiciary 28 C. 29 (15) The executive director of the Governor's Office of Elderly Affairs, or his 30 designee. Page 2 of 5 SR NO. 169 SLS 24RS-4440 ORIGINAL 1 (16) The president of the Building Officials Association of Louisiana, or his 2 designee. 3 (17) The executive director of the Apartment Association of Louisiana, Inc., or his 4 designee. 5 (18) The executive director of the Louisiana Home Builders Association of 6 Louisiana, or his designee. 7 (19) The executive director of the Louisiana Housing Corporation, or his designee. 8 (20) The president of the Louisiana Hospital Association, or his designee. 9 (21) The executive director of the Voice of the Experienced, or his designee. 10 (22) The executive director of the Louisiana Fair Housing Action Center, or his 11 designee. 12 BE IT FURTHER RESOLVED that the task force shall consider and make 13 recommendations on the following: 14 (1) All present federal and state laws, rules, and regulations, as well as local 15 ordinances in existence, to protect vulnerable individuals from degradation and exploitation 16 by certain property owners or landowners. 17 (2) Any state laws, rules, and regulations or local ordinances proposed, as necessary, 18 to protect vulnerable individuals from degradation and exploitation by certain property 19 owners or landowners. 20 (3) Any proposals for regulation of community-based residential settings in which 21 nonrelated individuals reside in a single dwelling and the rent or fees paid to the property 22 owner or landowner are derived from government-funded assistance, such as social security 23 payments, Supplemental Nutrition Assistance Program (SNAP) food stamps, or other federal 24 or state stipends or subsidies. 25 (4) Any civil or criminal penalties to be assessed against a property owner or 26 landowner who manipulates, scams, exploits, or stockpiles individuals in unclean, unsafe, 27 overcrowded, and unhealthy community-based residential settings. 28 (5) Any transition or relocation plan for vulnerable individuals who reside in a 29 community-based setting that is deemed unclean, unsafe, overcrowded, and unhealthy. 30 (6) Any other recommendation deemed important by the task force to address this Page 3 of 5 SR NO. 169 SLS 24RS-4440 ORIGINAL 1 matter. 2 BE IT FURTHER RESOLVED that each designating authority shall submit the 3 names of designees to the task force to the secretary of the Louisiana Department of Health 4 no later than September 1, 2024. 5 BE IT FURTHER RESOLVED the task force shall convene for its first meeting no 6 later than October 1, 2024, at the call of the secretary of the department of health, or his 7 designee, and at the first meeting, the members shall elect a chairman and other officers as 8 the task force may deem appropriate. 9 BE IT FURTHER RESOLVED that the Louisiana Department of Health shall be 10 responsible for providing staff support to assist the task force in performing its duties. 11 BE IT FURTHER RESOLVED that a majority of the task force shall constitute a 12 quorum for the transaction of business. All official actions of the task force shall require the 13 affirmative vote of a majority of the members. 14 BE IT FURTHER RESOLVED that the members of the task force shall serve 15 without compensation, except per diem or expenses reimbursement to which they may be 16 individually entitled as members of their constituent organizations. 17 BE IT FURTHER RESOLVED that the task force shall terminate on July 1, 2025. 18 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 19 secretary of the Louisiana Department of Health, the state health officer, the director of the 20 health standards section within the Louisiana Department of Health, the director of the adult 21 protective services section within the Louisiana Department of Health, the secretary of the 22 Department of Children and Family Services, the attorney general, the state fire marshal, the 23 executive director of the Louisiana Municipal Association, the executive director of the 24 Police Jury Association of Louisiana, the executive director of the Advocacy Center of 25 Louisiana, the executive director of the Louisiana Sheriffs' Association, the executive 26 director of the Louisiana District Attorneys Association, the executive director of the 27 Governor's Office of Elderly Affairs, the president of the Building Officials Association of 28 Louisiana, the executive director of the Apartment Association of Louisiana, Inc., the 29 executive director of the Louisiana Home Builders Association, the executive director of the 30 Louisiana Housing Corporation, the president of the Louisiana Hospital Association, the Page 4 of 5 SR NO. 169 SLS 24RS-4440 ORIGINAL 1 executive director of the Voice of the Experienced, and the executive director of the 2 Louisiana Fair Housing Action Center.
