SUPPLEMENTAL PAY:  Provides relative to qualifications for state supplemental pay for
firemen
1	AN ACT
2To amend and reenact R.S. 40:1666.1(A)(2), (4)(a), (6)(a), and (7)(a) and (B), relative to
3 qualifications for firemen that receive state supplemental pay; to provide for
4 standards for firemen's training program; to provide for an effective date; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 40:1666.1(A)(2), (4)(a), (6)(a), and (7)(a) and (B) are hereby
8amended and reenacted to read as follows:
9 ยง1666.1.  Extra compensation
10	A.

12	(2)  The term "employee" as used herein expressly excludes any person hired
13 primarily to perform secretarial and clerical duties, switchboard operators,
14 secretaries, record clerks, maintenance personnel, and mechanics; it shall expressly
15 exclude employees hired after March 31, 1986, who have not completed and passed
16 a certified fireman's training program from a Pro Board accredited agency or the
17 International Fire Service Accreditation Congress (IFSAC) equal to National Fire
18 Protection Association Standard 1001 Firefighter I Certification or a firefighter's
19 training program as approved by the office of state fire marshal Fire and Emergency
20 Training Academy in accordance with R.S. 40:1541 et seq.; and it shall also

1 expressly exclude part-time employees and volunteers of such municipal, parish,
2 tribe, or fire protection district fire departments.

4	(4)(a)  Every fire protection officer who is employed on a full-time basis by
5 a port authority headquartered in the city of New Orleans shall be paid by the state
6 extra compensation in the amount of six hundred dollars per month in addition to the
7 compensation now paid to him by his employer out of self-generated revenue
8 attributable to the agency employing such fire protection officers.  To be eligible for
9 the extra compensation, each such fire protection officer shall have completed one
10 year of service, and any such fire protection officer hired after March 31, 1986, shall
11 also have completed and passed a certified fireman's training program from a Pro
12 Board accredited agency or the International Fire Service Accreditation Congress
13 (IFSAC) equal to National Fire Protection Association Standard 1001 Firefighter I
14 Certification or a firefighter's training program as approved by the office of state fire
15 marshal Fire and Emergency Training Academy in accordance with R.S. 40:1541 et
16 seq., or other state or federally approved maritime firefighter training program.

18	(6)(a)  Every fire protection officer who is employed on a full-time basis by
19 the Plaquemines Port Harbor and Terminal District shall be paid by the state extra
20 compensation in the amount of six hundred dollars per month in addition to the
21 compensation now paid to him by his employer out of self-generated revenue
22 attributable to the agency employing the fire protection officers.  To be eligible for
23 the extra compensation, each fire protection officer shall have completed one year
24 of service, and any fire protection officer hired after March 31, 1986, shall also have
25 completed and passed a certified fireman's training program from a Pro Board
26 accredited agency or the International Fire Service Accreditation Congress (IFSAC)
27 equal to National Fire Protection Association Standard 1001 Firefighter I
28 Certification or a firefighter's training program as approved by the office of state fire

2 seq., or other state or federally approved maritime firefighter training program.

4	(7)(a)  Every fire protection officer who is employed on a full-time basis by
5 the Port of South Louisiana shall be paid by the state extra compensation in the
6 amount of six hundred dollars per month in addition to the compensation now paid
7 to him by his employer out of self-generated revenue attributable to the agency
8 employing the fire protection officers.  To be eligible for the extra compensation,
9 each fire protection officer shall have completed one year of service, and any fire
10 protection officer hired after March 31, 1986, shall also have completed and passed
11 a certified fireman's training program from a Pro Board accredited agency or the
12 International Fire Service Accreditation Congress (IFSAC) equal to National Fire
13 Protection Association Standard 1001 Firefighter I Certification or a firemen's
14 training program as approved by the Louisiana State University Firemen Training
15 Program in accordance with R.S. 40:1541 et seq., or other state or federally approved
16 maritime firefighter training programs.

18	B.  In computing the period of service required by Subsection A of this
19 Section, prior service of employees who have returned or who hereafter return to
20 such service shall be included; provided that service in any municipal, parish, tribe,
21 or fire protection district fire department, whether with the same fire department or
22 not, shall be used in computing such prior service.  Notwithstanding the provisions
23 of Subsection A of this Section to the contrary, any employee who received state
24 supplemental pay prior to March 31, 1986, and returns to such service shall be
25 entitled to receive state supplemental pay whether or not such employee completes
26 training for and obtains National Fire Protection Association Standard 1001
27 Firefighter I Certification from a Pro Board accredited agency or the International
28 Fire Service Accreditation Congress (IFSAC). or completes training and receives
29 certification from a firefighter's training program as approved by the office of state

2 40:1541 et seq.

4 Section 2.  This Act shall become effective upon signature by the governor or, if not
5signed by the governor, upon expiration of the time for bills to become law without signature
6by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
7vetoed by the governor and subsequently approved by the legislature, this Act shall become
8effective on the day following such approval.

Abstract:  Removes certification from training programs approved by the office of the state
fire marshal in favor of certification from training programs from accredited agencies
for purposes of firemen receiving state supplemental pay.
Present law provides for qualifications for firemen in order to receive state supplemental
pay.  Provides for firemen to complete and pass a certified firemen's training program equal
to the National Fire Protection Association Standard for 1001 Firefighter I certification or
a firefighter's training program as approved by the office of the state fire marshal.  Provides
an option for firefighters employed by ports to also obtain training through a state or
federally approved maritime firefighter training programs.
Proposed law repeals present law regarding certifications from a training program approved
by the office of the state fire marshal Fire and Emergency Training Academy and requires
firemen to complete and pass a certified firemen's training program from a Pro Board
accredited agency or the International Fire Service Accreditation Congress.  Retains the
option for firefighters employed by ports to obtain training through a state or federally
approved maritime firefighter training programs.
Effective upon signature of governor or lapse of time for gubernatorial action.
