HOUSE BILL NO. 318

HOUSING/MANUFACTURED:  Provides relative to manufactured and modular housing
in flood-prone areas
1	AN ACT
2To amend and reenact R.S. 51:912.22(8), relative to manufactured and modular housing in
3 flood-prone areas; to provide for minimum standards adopted by FEMA; to provide
4 for permit information; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 51:912.22(8) is hereby amended and reenacted to read as follows: 
7 ยง912.22.  Installation standards for manufactured and modular homes
8	All manufactured and modular homes shall be installed to meet the following
9 standards, unless otherwise specified in this Part:

11	(8)(a)  In Notwithstanding any other law to the contrary, in flood-prone areas,
12 the foundation shall comply with the requirements set forth in the manual,
13 Manufactured Home Installation In Flood Hazard Areas, published by the Federal
14 Emergency Management Agency (FEMA).  
15	(b)  For all installation in this state, state and local government subdivisions
16 shall not adopt any law, rule, ordinance, building code, or other measure to regulate
17 installations that are more restrictive than the minimum standards adopted by
18 FEMA's National Flood Insurance Program, under 42 U.S.C. Section 4011 et seq.
19 The limitation of restrictive installation standards included in this Paragraph shall
20 include federal laws, rules, and guidance that regulate home elevations and the areas

1 at or above the Base Flood Elevation or Free Board.  Any requirement issued, which
2 includes suggestions or guidelines referred to as best practices, that is ambiguous or
3 can be interpreted in more than one way shall be construed in favor of the
4 homeowner.
5	(c)  All permits issued from a jurisdiction's permit office shall include the
6 Base Flood Elevation on the property and the Free Board Elevation of the finished
7 floor based on the current adopted Flood Insurance Rate Map.

Abstract: Provides relative to manufactured and modular housing in flood-prone areas.
Present law provides that in flood-prone areas, the foundation of manufactured and modular
housing shall comply with the requirements set forth in the manual, Manufactured Home
Installation In Flood Hazard Areas, published by the Federal Emergency Management
Agency (FEMA).
Proposed law retains present law and adds that state and local government subdivisions shall
not enact requirements for stricter regulation of installation than the minimum standards
adopted by FEMA's National Flood Insurance Program, under 42 U.S.C. Section 4011 et
seq.
Proposed law provides for the limitation of restrictive installation standards regarding Free
Board.
Proposed law provides for what information shall be provided on permits issued.
