BUDGETARY PROCEDURES: Provides relative to Joint Legislative Committee on the
Budget approval of capital outlay change orders
1 AN ACT
2To amend and reenact R.S. 39:126, relative to change orders for a project in the Capital
3 Outlay Act; to provide relative to threshold amounts required for approval and
4 review by the Joint Legislative Committee on the Budget; to provide an effective
5 date; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 39:126 is hereby amended and reenacted to read as follows:
8 ยง126. Change orders
9 The prior approval of the Joint Legislative Committee on the Budget is
10 required for one or more change orders that cause an excess in the aggregate of one
11 hundred thousand two hundred fifty thousand dollars per month for a project
12 undertaken pursuant to an appropriation in the Capital Outlay Act. In addition, a
13 change order for a project undertaken pursuant to this Part shall also be subject to the
14 approval of the commissioner of administration. Any change order in excess of fifty
15 thousand dollars but less than one hundred thousand two hundred fifty thousand
16 dollars shall be submitted to the Joint Legislative Committee on the Budget for
17 review but shall not require committee approval.
18 Section 2. This Act shall become effective upon signature by the governor or, if not
19signed by the governor, upon expiration of the time for bills to become law without signature
20by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If

1vetoed by the governor and subsequently approved by the legislature, this Act shall become
2effective on the day following such approval.

Abstract: Increases the threshold amount of a change order that must be approved by the
Joint Legislative Committee on the Budget
Present law requires the Joint Legislative Committee on the Budget (JLCB) to approve a
change order that causes an excess in the aggregate amount of $100,000 per month for a
project in the Capital Outlay Act. Further requires JLCB to review any change order in
excess of $50,000 but less than $100,000.
Proposed law increases the threshold amount to $250,000 for those change orders requiring
JLCB approval. Also increases the threshold amount in excess of $50,000 but less than
$250,000 for those change orders requiring JLCB review.
Effective upon signature of governor or lapse of time for gubernatorial action.
