Abstract: Authorizes the parish president to remove a commissioner of the Houma-Terrebonne
Housing Authority without cause.
Present law (R.S. 40:531(D)) provides for the governance of the Houma-Terrebonne Housing
Authority by five commissioners appointed by the parish president including at least one tenant from
the housing developments operated by the authority.
Present law (R.S. 40:537(A)(1)) authorizes the chief elected official of a parish to remove a
commissioner of a local housing authority for neglect of duty, misconduct in office, or conviction
of any felony.
Proposed law authorizes the parish president to remove a commissioner of the Houma-Terrebonne
Housing Authority, excluding a tenant commissioner, without cause.
Present law (R.S. 40:537(B)(1)) requires notification of the removed commissioner and an appeals
hearing by the parish or municipal governing authority if such commissioner requests such a hearing
within 10 days of the notice of removal.
Proposed law requires the parish president to provide a notice of removal to a commissioner that is
removed pursuant to proposed law and a copy to the board of commissioners.  Provides that the
commissioner is removed upon receipt of the notice or 10 days following the date of the notice,
whichever is later.
