HOUSE BILL NO. 403

FUNDS/FUNDING:  Provides for the imposition of fines for driving offenses
1	AN ACT
2To enact R.S. 14:98.1(A)(4), 98.2(A)(5), 98.3(A)(4), 98.4(A)(3), 99(C), and 99.2(F), relative
3 to the imposition of fines for certain driving offenses; to provide for an increase in
4 fines related to the operation of a motor vehicle; to provide for the dedication of
5 revenue to the Louisiana Emergency Response Network Fund; to provide an
6 effective date; and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S.14:98.1(A)(4), 98.2(A)(5), 98.3(A)(4), 98.4(A)(3), 99(C), and 99.2(F)
9are hereby enacted to read as follows: 
10 §98.1.  Operating while impaired; first offense; penalties
11	A.

13	(4)(a)  In addition to the penalties imposed pursuant to this Section, upon
14 conviction of a first offense, the offender shall also be fined an additional twenty-
15 five dollars.
16	(b)  Monies collected pursuant to this Paragraph shall be forwarded by the
17 clerk of court to the state treasurer within thirty days of collection.
18	(c)  After allocation to the Bond Security and Redemption Fund as provided
19 in Article VII, Section (9)(B) of the Constitution of Louisiana, the state treasurer

1 shall deposit the collections into the Louisiana Response Network Fund as
2 established in R.S. 40:2845.

7	(5)(a)  In addition to the penalties imposed pursuant to this Section, upon
8 conviction of a second offense, the offender shall also be fined an additional fifty
9 dollars.
10	(b)  Monies collected pursuant to this Paragraph shall be forwarded by the
11 clerk of court to the state treasurer within thirty days of collection.
12	(c)  After allocation to the Bond Security and Redemption Fund as provided
13 in Article VII, Section (9)(B) of the Constitution of Louisiana, the state treasurer
14 shall deposit the collections into the Louisiana Response Network Fund as
15 established in R.S. 40:2845.

22 hundred dollars.

4	(3)(a)  In addition to the penalties imposed pursuant to this Section, upon
5 conviction of a fourth or subsequent offense, the offender shall also be fined an
6 additional two hundred fifty dollars.
7	(b)  Monies collected pursuant to this Paragraph shall be forwarded by the
8 clerk of court to the state treasurer within thirty days of collection.
9	(c)  After allocation to the Bond Security and Redemption Fund as provided
10 in Article VII, Section (9)(B) of the Constitution of Louisiana, the state treasurer
11 shall deposit the collections into the Louisiana Response Network Fund as
12 established in R.S. 40:2845.

14 §99.  Reckless operation of a vehicle

16	C.(1)  In addition to the penalties imposed pursuant to this Section, upon
17 conviction of the first offense, the offender shall also be fined an additional five
18 dollars.
19	(2)  In addition to the penalties imposed under this Section, upon conviction
20 of a second or subsequent offense, the offender shall also be fined an additional ten
21 dollars.
22	(3)  Monies collected pursuant to this Subsection shall be forwarded by the
23 clerk of court to the state treasurer within thirty days of collection.
24	(4)  After allocation to the Bond Security and Redemption Fund as provided
25 in Article VII, Section (9)(B) of the Constitution of Louisiana, the state treasurer
26 shall deposit the collections into the Louisiana Response Network Fund as
27 established in R.S. 40:2845.

3	F.(1)  In addition to the penalties imposed pursuant to this Section, upon
4 conviction the offender shall also be fined an additional five dollars.
5	(2)  Monies collected pursuant to this Subsection shall be forwarded by the
6 clerk of court to the state treasurer within thirty days of collection.
7	(3)  After allocation to the Bond Security and Redemption Fund as provided
8 in Article VII, Section (9)(B) of the Constitution of Louisiana, the state treasurer
9 shall deposit the collections into the Louisiana Response Network Fund as
10 established in R.S. 40:2845.
11 Section 2.  This Act shall become effective upon signature by the governor or, if not
12signed by the governor, upon expiration of the time for bills to become law without signature
13by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
14vetoed by the governor and subsequently approved by the legislature, this Act shall become
15effective on the day following such approval.

Abstract:  Increases fines for driving offenses and dedicates the revenues collected to the
Louisiana Emergency Network Response Fund.
Present law provides for the crime of operating a motor vehicle while impaired and imposes
penalties for violations. The fines imposed upon the conviction of the various offenses are
as follows:
(1)  First Offense Not less than $300 nor more than $1,000
(2)  Second Offense Not less than $750 nor more than $1,000
(3)  Third Offense $2,000
(4)  Fourth or Subsequent Offense$5,000
Proposed law adds the following additional fines upon conviction for each offense:
(1)  First Offense $25

(2)  Second Offense $50
(3)  Third Offense $100
(4)  Fourth or Subsequent Offense$250
Present law provides for the crime of reckless operation of a vehicle and imposes penalties
for violations.  The fine for a first offense conviction is not more than $200.  The fine
imposed upon the conviction of the second or subsequent offenses is not less than $25 nor
more than $500.  
Proposed law adds the following additional fines upon conviction for each offense:
(1)  First Offense $5
(2)  Second or Subsequent Offense$10
Present law provides for the crime of reckless operation of an off-road vehicle and imposes
penalties for violations.  The fine for a conviction is not more than $500.
Proposed law adds an additional fine upon conviction of $5.
Proposed law instructs the clerk of court to collect each of the additional fines imposed and
forward to the state treasurer for deposit into the Louisiana Response Network Fund.
Present law establishes the Louisiana Emergency Response Network Fund.  Monies in the
fund are used to fund grants, projects, and services to support the board of the Louisiana
Emergency Response Network.  The board's objectives are to decrease trauma, stroke, and
STEMI-related deaths.  Proposed law retains present law.
Effective upon signature of governor or lapse of gubernatorial action.
