HOUSE BILL NO. 43
BY REPRESENTATIVE JACKSON
APPROPRIATIONS/JUDGMENT:  Appropriates funds for payment of certain consent
judgments against the state in the suit entitled William Mangum, individually and as
surviving father of Hayden Lane Mangum v. La. Department of Wildlife and
Fisheries et al. consolidated with Jacke Shaw Mangum v. State of La. et al.
1	AN ACT
2Relative to the appropriation of monies out of the state general fund to be used to pay certain
3 consent judgments in the case captioned "William Mangum, individually and as
4 surviving father of Hayden Lane Mangum versus Louisiana Department of Wildlife
5 and Fisheries and ABC Insurance Company, in solido consolidated with Jacke Shaw
6 Mangum versus State of Louisiana Department of Transportation and Wildlife and
7 Fisheries and ABC Insurance Company, in solido" against the state of Louisiana,
8 through the Department of Transportation and Development and in favor of William
9 Mangum and Jackie Shaw Mangum; to provide for certain requirements and
10 limitations; to provide for interest; to provide for expenses and expert witness fees;
11 to provide for court costs; to provide for an effective date; and to provide for related
12 matters.
13Be it enacted by the Legislature of Louisiana:
14 Section 1.  The sum of Three Hundred Thirty Thousand and No/100 ($330,000.00)
15Dollars is hereby payable out of the State General Fund (Direct) for Fiscal Year 2024-2025
16for payment of the consent judgments against the state described in Sections 2 and 3 of this
17Act in the case captioned "William Mangum, individually and as  surviving father of Hayden
18Lane Mangum versus Louisiana Department of Wildlife and Fisheries and ABC Insurance
19Company, in solido consolidated with Jacke Shaw Mangum versus State of Louisiana

1Department of Transportation and Wildlife and Fisheries and ABC Insurance Company, in
2solido".
3 Section 2.  Of the amount appropriated in Section 1 of this Act, an amount equal to
4the sum of One Hundred Sixty-Five Thousand and No/100 ($165,000.00) Dollars is hereby
5payable for the consent judgment signed on May 29, 2024, against the state of Louisiana,
6through the Department of Transportation and Development, and in favor of William
7Mangum, bearing Number C-167,370-B, on the docket of the Twenty-Sixth Judicial District,
8parish of Bossier, state of Louisiana.
9 Section 3.  Of the amount appropriated in Section 1 of this Act, an amount equal to
10the sum of One Hundred Sixty-Five Thousand and No/100 ($165,000.00) Dollars is hereby
11payable for the consent judgment signed on May 24, 2024, against the state of Louisiana,
12through the Department of Transportation and Development, and in favor of Jackie Shaw
13Mangum, bearing Number C-167,521, on the docket of the Twenty-Sixth Judicial District,
14parish of Bossier, state of Louisiana.
15 Section 4.  A judgment may only be paid from this appropriation if it is final and
16shall be paid as to principal, court costs, and expert witness fees as awarded in the judgment. 
17Interest shall be paid as provided by law and awarded in the judgment.  If the provisions of
18the judgment conflict with the provisions of this Act, the provisions of the judgment shall
19be controlling.  Any other provision of this Act not in conflict with the provisions of the
20judgment shall control.  Payment shall be made only after presentation to the state treasurer
21of documentation required by the state treasurer.  Further, the judgment shall be deemed to
22have been paid on the effective date of this Act, and interest shall cease to run as of that date. 
23 Section 5.  This Act shall become effective upon signature by the governor or, if not
24signed by the governor, upon expiration of the time for bills to become law without signature
25by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
26vetoed by the governor and subsequently approved by the legislature, this Act shall become
27effective on the day following such approval.

of La. Dept. of Transportation et al., bearing No. C-167,370-B consolidated with No. C-
167,521, on the docket of the 26

 Judicial District, parish of Bossier:
(1)$165,000.00 for the consent judgment against the state of Louisiana, through the
Department of Transportation and Development, and in favor of William Mangum,
signed on May 29, 2024. 
(2) $165,000.00 for the consent judgment against the state of Louisiana, through the
Department of Transportation and Development, and in favor of Jackie Shaw
Mangum, signed on May 24, 2024. 
Proposed law provides relative to payment. Provides relative to conflicts between the
judgment and proposed law. Prohibits accrual of interest on the judgment as of the effective
date of proposed law.
Effective upon signature of governor or lapse of time for gubernatorial action.
