HOSPITALS:  Creates an exception to hospital credentialing requirements in certain
circumstances
1	AN ACT
2To enact R.S. 40:2109.4, relative to the authority to practice in a healthcare facility; to
3 establish emergency privileges; to provide for qualifications; to establish time
4 sensitive requirements; to provide for definitions; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 40:2109.4 is hereby enacted to read as follows: 
7 ยง 2109.4  Emergency privileges
8	A.(1)  A transferring hospital shall grant emergency privileges to a qualified
9 healthcare professional to provide care to a patient admitted to the transferring
10 hospital for a limited purpose and duration.
11	(2)  A healthcare professional shall be granted emergency privileges to
12 provide care if he is performing a unique procedure intended to stabilize the patient
13 for transfer to another hospital or healthcare facility, and the healthcare professional
14 is credentialed to perform the same unique procedure at the hospital receiving the
15 patient.  A healthcare professional shall provide and the transferring hospital shall
16 verify the credential from the receiving hospital.
17	(3)  The emergency privileges to provide care are valid for the duration of the
18 unique procedure.

1	B.(1)  A healthcare professional shall inform the transferring hospital that he
2 intends to seek emergency privileges to provide care prior to departing for the
3 hospital.
4	(2)  The transferring hospital shall grant the authority to provide care within
5 one hour of receiving the notice described in Paragraph (1) of this Subsection.
6	C.  For the purposes of this Section, the following terms have the following
7 meanings:
8	(1)  "Healthcare professional" means a physician and any associated staff
9 necessary to complete a unique procedure.
10	(2)  "Unique procedure" means a treatment such as extracorporeal membrane
11 oxygenation and procedures associated with organ transplantation.

Abstract: Requires a hospital to grant emergency privileges that allow a healthcare
professional to perform a unique procedure on a patient in hospital where he is not
generally authorized to practice medicine.
Proposed law requires a hospital transferring a patient to another hospital to grant emergency
privileges that allow a qualified healthcare professional to administer a unique procedure to
a patient admitted to the transferring hospital.
Proposed law states that a healthcare professional shall qualify for emergency privileges if
he is performing a unique procedure intended to stabilize a patient, and he is credentialed
to provide the same procedure in the hospital receiving the patient.
Proposed law provides that emergency privileges are valid for the duration of the unique
procedure. 
Proposed law states that the healthcare professional shall provide notice to the transferring
hospital that he intends to perform a unique procedure at the visiting hospital, and the
hospital has one hour from receiving the notice to grant emergency privileges.
