ENERGY/CONSERVATI ON: Places a moratorium on carbon dioxide sequestration 1 AN ACT 2To enact R.S. 30:1116 and to repeal R.S. 30:1116, relative to a moratorium on carbon 3 dioxide sequestration; to provide for a moratorium on carbon dioxide sequestration; 4 to provide for a moratorium on the transportation of carbon dioxide for geologic 5 sequestration; to provide for a moratorium on permitting related to carbon dioxide 6 sequestration; to repeal the moratorium after it expires; to provide for effective dates; 7 and to provide for related matters. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 30:1116 is hereby enacted to read as follows: 10 ยง1116. Moratorium 11 Notwithstanding any other provision of law to the contrary, in order to allow 12 for the study of risks to security and private property rights associated with carbon 13 dioxide sequestration, there is hereby declared a moratorium on the geologic storage 14 or sequestration of carbon dioxide, the transportation of carbon dioxide within the 15 state for the purpose of geologic storage or sequestration, and the issuance of any 16 permits, certificates, or orders related to these activities, which shall remain in effect 17 until July 1, 2026. 18 Section 2. If this Act is vetoed by the governor and 3subsequently approved by the legislature, this Section and Section 1of this Act shall become 4effective on the day following such approval. 5 (B) Section 2 of this Act shall become effective on July 1, 2026. Proposed law prohibits the following activity from the effective date of the proposed law until July 1, 2026: (1)Geologic sequestration of carbon dioxide within the state. (2)Transportation of carbon dioxide within the state for purposes of geologic sequestration. (3)The issuance of permits, certificates, and orders related to activities (1) and (2). Proposed law repeals the moratorium after its term has expired. Effective in part upon signature of the governor; effective in part July 1, 2026.
