FIRE PROTECT/FIRE DEPTS:  Provides relative to costs for certain emergency services
provided by fire departments and fire protection districts
1	AN ACT
2To enact Subpart A-1 of Part II of Chapter 4 of Title 33 of the Louisiana Revised Statutes
3 of 1950, to be comprised of R.S. 33:1980.1, relative to fire departments and fire
4 protection districts; to provide relative to emergency services provided by such
5 departments and districts; to provide for reimbursement of certain costs; and to
6 provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  Subpart A-1 of Part II of Chapter 4 of Title 33 of the Louisiana Revised
9Statutes of 1950, comprised of R.S. 33:1980.1, is hereby enacted to read as follows:
10 SUBPART A-1.  FIRE DEPARTMENTS; SERVICES; COSTS
11 ยง1980.1.  Fire departments; costs for certain emergency services
12	A.(1)  Notwithstanding any other provision of law to the contrary, any parish
13 or municipal fire department, or any fire protection district or volunteer fire
14 department may seek reimbursement for the cost of medical services provided to an
15 individual.  Any such fire department or fire protection district may also seek
16 reimbursement for the cost of automobile extraction services provided to an
17 individual involved in a motor vehicle accident.  Costs for medical services provided
18 to an individual may be recovered from the individual or the individual's personal
19 health insurance.  Costs for automobile extraction services may be recovered from

1 the automobile insurance company of the individual at fault for the motor vehicle
2 accident.
3	(2)  If a fire department or fire protection district provides medical services
4 to an individual or automobile extraction services to an individual involved in a
5 motor vehicle accident at the request of an emergency service provider, the fire
6 department or fire protection district may seek reimbursement for costs of the
7 medical services or automobile extraction services from the emergency service
8 provider.
9	B.  Any fire department or fire protection district seeking reimbursement for
10 costs for medical services or automobile extraction services shall submit to the
11 respective individual, insurance company, or emergency service provider, an
12 itemized invoice with corresponding receipts and an explanation of each service for
13 which payment is requested.
14	C.(1)  The governing board of any fire department or fire protection district
15 seeking reimbursement for its costs pursuant to this Section for medical services or
16 automobile extraction services may use any reasonable means to collect and enforce
17 the collection of such costs.
18	(2)  In any lawsuit to enforce the collection of such costs, the governing
19 board of the fire department or fire protection district may recover court costs and
20 reasonable attorney fees.

Proposed law authorizes fire departments and fire protection districts to seek reimbursement
for the cost of medical services provided to an individual and for automobile extraction
services provided to an individual involved in a motor vehicle accident.  Provides that costs
for medical services may be recovered from the individual or the individual's personal health
insurance.  Additionally provides that the costs for automobile extraction services may be

recovered from the automobile insurance company of the individual at fault for the motor
vehicle accident.
Proposed law authorizes fire departments and fire protection districts to seek reimbursement
from an emergency service provider for services provided pursuant to proposed law if the
fire departments or fire protection districts provided the services at the request of the
emergency service provider.
Proposed law requires fire departments or fire protection districts who are seeking
reimbursement to submit an itemized invoice with corresponding receipts and an explanation
of each service for which payment is requested.  Authorizes the fire departments and fire
protection districts to use any reasonable means to collect and enforce the collection of such
costs.
