HOUSE BILL NO. 612

SEWERAGE/N O WATER BD:  Provides relative to the Sewerage and Water Board of
New Orleans
1	AN ACT
2To amend and reenact R.S. 33:4076, relative to the city of New Orleans; to provide relative
3 to the sewerage and water board; to provide relative to the employees of the board;
4 to require the board to establish and maintain employment lists; to provide for
5 effectiveness; and to provide for related matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 33:4076 is hereby amended and reenacted to read as follows:
11 §4076.  Employees of board; civil service
12	A.  The board may employ all necessary clerks, engineers, firemen, and other
13 skilled and unskilled employees necessary and proper to the efficient administration,
14 operation, and control of the public sewerage, water, and drainage systems.  All of
15 the employees, except unskilled laborers, shall be appointed only after they have
16 passed the civil service examination administered by the civil service commissioners
17 of the city of New Orleans.  Other than executive management positions, if an
18 employment position cannot be filled with a New Orleans resident within ninety days
19 after the position has been advertised, the board may employ a person who is not a
20 New Orleans resident and who shall remain exempt from the city's residency

1 requirement for the duration of his employment.  They shall hold their positions
2 during good behavior and shall be removed only for cause.  Nothing in this Section
3 shall be construed as preventing the board from dispensing with the services of
4 unnecessary employees.  Civil service rules shall not apply to the executive director,
5 the general superintendent, or the Board of Advisory Engineers.
6	B.  The board shall establish and maintain employment lists containing names
7 of persons eligible for appointment to the various positions to be filled by the board.
8 Section 2.  This Act shall take effect and become operative if and when the proposed
9amendment of Article X of the Constitution of Louisiana contained in the Act which
10originated as House Bill No. ____ of this 2025 Regular Session of the Legislature is adopted
11at a statewide election and becomes effective.

the various positions to be filled by the board.
Present law (R.S. 33:4071) establishes the sewerage and water board (board) of the city of
New Orleans.  Provides for the composition and powers and duties of the board.
Proposed law retains present law.
Present law authorizes the board to employ all necessary clerks, engineers, firemen, and
other skilled and unskilled employees necessary and proper to the efficient administration,
operation, and control of the public sewerage, water, and drainage systems.  Requires, prior
to appointment, that all employees, except unskilled laborers, pass the civil service
examination administered by the civil service commissioners of the city of New Orleans.
Proposed law retains present law and additionally requires the board to establish and
maintain employment lists containing names of persons eligible for appointment to the
various positions to be filled by the board.
Effective if and when the proposed amendment of Article X, §§1(B) and 12(B) of the
Constitution of La. contained in the Act which originated as House Bill No. ___ of this 2025
R.S. of the Legislature is adopted at a statewide election and becomes effective.
