HOUSE BILL NO. 641

ENERGY:  Authorizes the governing authority of Jefferson Davis Parish to determine
whether Class VI carbon dioxide injection wells may be permitted within the parish
1	AN ACT
2To enact R.S. 30:1104(G) and 1104.3, relative to Class VI injection well permitting; to
3 authorize the governing authority of Jefferson Davis Parish to determine whether
4 Class VI wells may be permitted within the parish; to provide for notice to the
5 Department of Energy and Natural Resources; to provide an effective date; and to
6 provide for related matters.
7	Notice of intention to introduce this Act has been published
8	as provided by Article III, Section 13 of the Constitution of
9	Louisiana.
10Be it enacted by the Legislature of Louisiana:
11 Section 1.  R.S. 30:1104(G) and 1104.3 are hereby enacted to read as follows:
12 §1104.  Duties and powers of the commissioner; rules and regulations; permits

14	G.  Notwithstanding any provision of law to the contrary, Class VI injection
15 wells shall not be permitted in any parish where prohibited pursuant to the local
16 option procedure set forth in this Chapter.

18 §1104.3.  Local option; Jefferson Davis Parish
19	The governing authority of Jefferson Davis Parish may by resolution or
20 ordinance determine whether Class VI injection wells may be permitted within the

1 parish.  A copy of any resolution or ordinance passed for this purpose shall be
2 provided to the department.
3 Section 2.  This Act shall become effective upon signature by the governor or, if not
4signed by the governor, upon expiration of the time for bills to become law without signature
5by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
6vetoed by the governor and subsequently approved by the legislature, this Act shall become
7effective on the day following such approval.

Abstract:  Authorizes the Jefferson Davis Parish governing authority to determine whether
Class VI carbon dioxide injection wells may be permitted within the parish.
Present law authorizes the Dept. of Energy and Natural Resources to permit Class VI carbon
dioxide injection wells within the state.
Proposed law creates an exception to the department's permitting authority where Class VI
wells have been prohibited by the local option procedure provided in proposed law.
Proposed law authorizes the Jefferson Davis Parish governing authority to determine
whether Class VI wells may be permitted within the parish by passing an ordinance or
resolution.
Proposed law requires the parish governing authority to notify the department of any
resolution or ordinance passed for the purpose of prohibiting or allowing Class VI injection
wells within the parish.
Effective upon signature of governor or lapse of time for gubernatorial action.
