MOTOR VEHICLES. Provide for penalties for certain traffic offenses. (8/1/25)
1	AN ACT
2 To amend and reenact R.S. 32:71(B)(2), relative to the operation of a motor vehicle on the
3 right side of the road; to provide for fines for certain offenses; to include secondary
4 and tertiary level offenses; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 32:71(B)(2) is hereby amended and reenacted to read as follows:

10	(2) In addition to the requirement of Paragraph 1 hereof, any Any vehicle
11 proceeding on a multilane highway at a speed slower than ten miles per hour less
12 than the posted maximum speed limit shall be driven in the right hand lane then
13 available for traffic, or as close as practicable to the right hand curb or edge of the
14 roadway, except when overtaking and passing a vehicle proceeding in the same
15 direction or when preparing for a left turn at an intersection or into a private road or
16 driveway. Persons in violation of this Paragraph shall be punished by a fine of not
17 more than one hundred dollars, or by imprisonment for not more than thirty days, or

2	(a) A fine of one hundred fifty dollars for the first offense.
3	(b) A fine of two hundred fifty dollars for a second subsequent offense
4 within a twelve month period of the first offense.
5	(c) A fine of three hundred fifty dollars for a third subsequent offense
6 within a twelve month period of the first offense or imprisonment for not more
7 than thirty days, or both.

Present law provides vehicles driven at a speed of 10 miles per hour less than the posted
speed limit in the left lane, other than for practicable purposes, are fined $100 or less, or no
more than 30 days imprisonment, or both.
Proposed law removes the 10 miles per hour or less parameter for the purposes of
punishment.
Proposed law further changes the fine from $100 or less to a first offense of $150, second
offense of $250, and third offense of $350. Proposed law further allows imprisonment of up
to 30 days for a third subsequent offense within a 12 month period of the first offense or
imprisonment up to 30 days, or both.
Effective August 1, 2025.
