PRESCRIPTION. Provides for a legal holiday in the accrual of prescription.  (8/1/25)
1	AN ACT
2 To amend and reenact Civil Code Art. 3454, relative to prescription; to provide for a legal
3 holiday in the expiration of the last day of the prescriptive period; and to provide for
4 related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. Civil Code Art. 3454 is hereby amended and reenacted to read as follows:
7 Art. 3454. Computation of time
8	In computing a prescriptive period, the day that marks the commencement
9 of prescription is not counted. Prescription accrues upon the expiration of the last day
10 of the prescriptive period, and if that day is a Saturday, Sunday, or legal holiday,
11 prescription accrues upon the expiration of the next day that is not a legal holiday.

Present law (C.C. Art. 3454) provides that in computing a prescriptive period, the day that
marks the commencement of prescription is not counted.
Present law provides that prescription accrues upon the expiration of the last day of the

expiration of the next day that is not a legal holiday.
Proposed law clarifies that prescription accrues upon the expiration of the last day of the
prescriptive period, and if that day is a Saturday, Sunday, or legal holiday, prescription
accrues upon the expiration of the next day that is not a legal holiday.
Effective August 1, 2025.
