TRANSPORTATION/DEV DEPT. Requires the Department of Transportation and
Development to use certain bidding process to discourage delays and incentivize the early
completion of road construction projects. (gov sig)
1	AN ACT
2 To enact R.S. 48:2086, relative to the Department of Transportation and Development; to
3 provide for methods of bidding contracts for road construction; to provide for
4 contract provisions to decrease delays in the completion of roads; to provide for
5 incentives for contractors to complete road construction contracts prior to the
6 contracted deadline; to provide for an effective date; and to provide for related
7 matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 48:2086 is hereby enacted to read as follows:
10 ยง2086. A+B bidding; authority
11	A. The legislature declares it to be in the public interest that in order to
12 increase efficiency and expediency and to reduce lengthy road construction
13 projects for the construction of state highways, the Department of
14 Transportation and Development shall employ the A+B bidding method for
15 road and highway construction projects or other best project delivery method
16 practices.
17	B.(1) Notwithstanding any other provision of law to the contrary,

1 contracts executed on or after July 1, 2025, for road construction by the
2 department shall incorporate necessary provisions to discourage the contractor
3 from exceeding the project completion date and shall preclude excessive change
4 orders.
5	(2) A provision shall be included in all contracts that provides incentives
6 to contractors for projects completed prior to the projected completion date.
7	C. For purposes of this Section, "A+B bidding" means the cost-plus-time
8 bidding method where the total bid is the sum of the traditional contract unit
9 price items "A" and the estimated time to complete the project "B", with the
10 lowest combined total determining the winning bid.
11 Section 2. This Act shall become effective upon signature by the governor or, if not
12 signed by the governor, upon expiration of the time for bills to become law without signature
13 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
14 vetoed by the governor and subsequently approved by the legislature, this Act shall become
15 effective on the day following such approval.

other best practices in all road construction contracts to reduce the completion time.
Requires that contracts contain necessary provisions to discourage contractors from delaying
the road construction completion date, including delays caused by excessive change orders.
Provides for incentives that reward contractors for projects completed prior to the contracted
date of completion. 
Effective upon signature of the governor or lapse of time for gubernatorial action.
