Creates the crime of theft of critical infrastructure. (8/1/25) 1 AN ACT 2 To enact R.S. 14:67.24, relative to theft; to create the crime of theft of critical infrastructure; 3 to provide definitions and penalties; and to provide for related matters. 4 Be it enacted by the Legislature of Louisiana: 5 Section 1. R.S. 14:67.24 is hereby enacted to read as follows: 6 ยง67.24. Theft of critical infrastructure 7 A. Theft of critical infrastructure is the misappropriation, taking, or 8 illegal possession, as defined in R.S. 14:69(A), of critical infrastructure. The 9 intent to deprive the owner permanently of the critical infrastructure is 10 essential. 11 B. As used in this Section, "critical infrastructure" shall have the same 12 meaning as provided in R.S. 14:61. 13 C.(1) Whoever commits the crime of theft of critical infrastructure when 14 the misappropriation, taking, or illegal possession amounts to a value of less 15 than twenty-five thousand dollars shall be fined not more than ten thousand 16 dollars, or imprisoned, with or without hard labor, for not more than fifteen 17 years, or both. SB NO. 22 SLS 25RS-233 ENGROSSED 1 (2) Whoever commits the crime of theft of critical infrastructure when 2 the misappropriation, taking, or illegal possession amounts to a value of twenty- 3 five thousand dollars or more shall be fined not more than fifty thousand 4 dollars, or imprisoned at hard labor for not more than twenty years, or both. 5 (3) Whoever commits the crime of theft of critical infrastructure wherein 6 it is foreseeable that human life will be threatened as a result of the theft shall 7 be fined not more than fifty thousand dollars, or imprisoned at hard labor for 8 not more than twenty years, or both. 9 D. In addition to the penalties provided in Subsection C of this Section, 10 the offender shall be ordered to make full restitution to the victim. If the 11 offender is found to be indigent and therefore unable to make restitution in full 12 at the time of conviction, the court shall order a periodic payment plan 13 consistent with the offender's financial ability. [R.S. 1:13(B) and 24:177(E)] DIGEST SB 22 Engrossed 2025 Regular Session Hodges Proposed law creates the crime of theft of critical infrastructure and makes it a crime to misappropriate, take, or illegally possess any critical infrastructure belonging to another with the intent to permanently deprive the owner of whatever was taken. Proposed law provides definitions relative to proposed law. Proposed law provides that a person convicted of theft of critical infrastructure when the misappropriation, taking, or illegal possession amounts to a value of less than $25,000 will be fined not more than $10,000, or imprisoned, with or without hard labor, for not more than 15 years, or both. Proposed law provides that a person convicted of theft of critical infrastructure when the misappropriation, taking, or illegal possession amounts to a value of $25,000 or more will be fined not more than $50,000, or imprisoned at hard labor for not more than 20 years, or both. Proposed law provides that a person convicted of theft of critical infrastructure wherein it is foreseeable that human life will be threatened as a result of the theft will be fined not more than $50,000, or imprisoned at hard labor for not more than 20 years, or both. Proposed law provides that a person convicted of theft of critical infrastructure, in addition to other proposed law penalties, will be ordered to make full restitution to the victim in accordance with present law.
