FISH/FISHING. Provides for recording of commercial receipts for fish sold. (8/1/25)
1	AN ACT
2 To amend and reenact R.S. 56:306.5(B), relative to seafood dealer receipts; to provide for
3 transmission to commercial fishermen; to provide for time delays; and to provide for
4 related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 56:306.5(B) is hereby amended and reenacted to read as follows:

9	B.(1) Wholesale/retail seafood dealers purchasing or acquiring fish from
10 commercial fisherman shall complete a commercial receipt form. The commercial
11 receipt form shall be a three-part form signed by both the commercial fisherman and
12 the wholesale/retail seafood dealer or his designee, attesting to that the information
13 required to be provided by each is correct. One part of the receipt form shall be
14 retained by the wholesale/retail seafood dealer, one part shall be given transmitted
15 to the commercial fisherman at the time within twenty-four hours of the
16 transaction, and one part shall be transmitted to the secretary of the Department of
17 Wildlife and Fisheries as provided for in R.S. 56:306.6.

1	(2) The wholesale/retail seafood dealer is responsible for recording on the
2 commercial receipt form that information provided by the commercial fisherman as
3 specified in R.S. 56:303.7, and is responsible for the following information at the
4 time of within twenty-four hours of each purchase or transfer of possession of the
5 a catch from a commercial fisherman to a wholesale/retail seafood dealer:
6 wholesale/retail seafood dealer's name and license number, commercial fisherman's
7 name, license number and signature, transaction date, species identification, quantity
8 and units of each species, size and condition of each species, unit price of each
9 species, and permit number for species requiring a permit to harvest.

Present law requires wholesale and retail seafood dealers acquiring fish from commercial
fisherman to complete a receipt recording certain information related to the transaction and
to provide the receipt to the fisherman at the time of the transaction.
Proposed law retains present law and requires that the receipt be transmitted to the fisherman
within 24 hours of the transaction.
Present law provides that the dealer is responsible for information recorded on receipt,
including dealer's name and license number, fisherman's name, license number and
signature, transaction date, species, quantity and units of each species, size and condition of
each species, unit price of each species, and permit number if required, at the time of the
transaction.
Proposed law retains present law and provides that the dealer is responsible for the recorded
information with 24 hours of the transaction.
Effective August 1, 2025.
