SENATE BILL NO. 37

MOTOR VEHICLES. Provides for the Louisiana Motor Vehicle Commission. (8/1/25)
1	AN ACT
2 To amend and reenact the introductory paragraph of R.S. 32:1253(A), 1253(A)(1), (D), (E),
3 (F), and (H), relative to the Louisiana Motor Vehicle Commission; to provide for
4 members of the motor vehicle commission; to provide for the powers and duties of
5 the commission; to provide for technical changes; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. The introductory paragraph of R.S. 32:1253(A), 1253(A)(1), (D), (E), (F)
8 and (H) are hereby amended and reenacted to read as follows:
9 ยง1253. Motor Vehicle Commission; appointment and qualifications of members;
10	terms of office; organization; oath; official bond; compensation;
11	powers and duties
12	A. The Louisiana Motor Vehicle Commission is hereby created within the
13 office of the governor and shall be composed of eighteen members commissioners
14 appointed by the governor, as follows:
15	(1) A chairman of the commission shall be appointed from the state at large.
16 Fourteen members commissioners shall be appointed in such a manner that at least
17 one shall be from each of the commission districts as listed below:

2	D. The commission shall appoint a qualified person to serve as executive
3 director thereof, to serve at the pleasure of the commission and shall fix his salary
4 and shall define and prescribe his duties. The executive director shall be in charge
5 of the commission's office and shall devote such time to the duties thereof, as may
6 be necessary to carry out their responsibilities. Said The commission may employ
7 such clerical and professional help and incur such expenses as may be necessary for
8 the proper discharge of its duties under this Chapter. The commission shall maintain
9 its office and transact its business in Jefferson Parish, and it is authorized to adopt
10 and use a seal.
11	E. The commission is hereby vested with the powers and duties necessary
12 and proper to enable it to fully and effectively carry out the provisions and objects
13 of this Chapter., and The commission is hereby authorized and empowered to make
14 and enforce all reasonable rules and regulations, and to adopt and prescribe all forms
15 necessary to accomplish said the purpose, and. the The enumeration of any power
16 or authority herein shall not be construed to deny, impair, disparage, or limit any
17 others necessary to the attainment thereof, provided no rule or regulation of the
18 commission, including but not limited to Chapter 7 (Advertising) of Subpart 1 of Part
19 V of Title 46, comprised of LAC 46:V:701 through 741, of the Louisiana
20 Administrative Code, shall prohibit a dealer from making a monetary donation or
21 contribution that does not directly involve the sale or lease of a motor vehicle in
22 connection with an advertising campaign. A copy of all rules and regulations adopted
23 by the commission shall be published in the Louisiana Administrative Code, as they
24 may be amended, modified, or repealed from time to time.
25	F. All fees and charges under the provisions of this Chapter shall be collected
26 and received by the executive director of the commission and shall be disbursed by
27 him the executive director at the direction of the commission in administering and
28 enforcing the provisions of this Chapter.

1	H. The commission shall, in addition to the powers herein conferred, be
2 constituted a body politic or political corporation, invested with the powers inherent
3 in corporations, including but not limited to the power and authority to own
4 immovable property. It may sue and be sued under the style of the commission, and
5 all process against the commission shall be served on the chairman or executive
6 director in person, and all suits on behalf of the commission shall be brought by the
7 chairman. The domicile for the purpose of being sued shall be Jefferson Parish. No
8 member of the commission, or the executive director, shall be subject to suit or be
9 held liable as an individual in any suit against the commission.

Present law provides for 18 members of the commission to be appointed by the governor.
Proposed law changes members to commissioners.
Present law provides for the commission to appoint a qualified person to serve as executive
director. Present law further provides for the commission to have the powers and duties
necessary to effectively carry out the objectives of the commission.
Proposed law retains present law and provides for technical changes.
Effective August 1, 2025.
