1	AN ACT
2 To amend and reenact R.S. 44:4.1(B)(11) and to enact R.S. 22:575, relative to data
3 submitted to the Department of Insurance; to require certain reports to be filed with
4 the commissioner; to provide for form promulgation; to authorize rule promulgation;
5 to provide for confidentiality; to provide for an effective date; and to provide for
6 related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 22:575 is hereby enacted to read as follows:
9 §575. Data reports; residential property insurers
10	A. Each authorized insurer or insurer group doing business in this state
11 shall file on a monthly basis a supplemental report on an individual and group
12 basis with information on personal and commercial residential coverage policies
13 in this state. The report shall be on a form prescribed by the commissioner, and
14 shall be due by the twentieth day of the month following the month the
15 supplemental report covers. The supplemental report shall include separate
16 information for personal residential coverage policies and for commercial
17 residential coverage policies and totals for each item specified including but not

1 limited to premiums written for each of the property lines of business. The
2 report shall include the following information for each zip code in this state:
3	(1) Total number of policies in force at the end of each month.
4	(2) Total number of policies canceled.
5	(3) Total number of policies nonrenewed.
6	(4) Number of policies canceled due to hurricane risk.
7	(5) Number of policies nonrenewed due to hurricane risk.
8	(6) Number of new policies written.
9	(7) Total dollar value of structure exposure under policies that include
10 wind coverage.
11	(8) Number of policies that exclude wind coverage.
12	(9) Number of claims opened each month.
13	(10) Number of claims closed each month.
14	(11) Number of claims pending each month.
15	(12) Number of claims in which either the insurer or insured invoked any
16 form of alternative dispute resolution, and specifying which form of alternative
17 dispute resolution was used.
18	B. Each authorized insurer or insurer group issuing personal or
19 commercial residential coverage policies in this state shall file with the
20 commissioner on an annual basis, in conjunction with the annual statements, a
21 supplemental report on an individual and group basis for closed claims. The
22 report shall be on a form prescribed by the commissioner and include the
23 following information for each claim closed, excluding liability only claims,
24 within the reporting period in this state:
25	(1) The unique claim identification number.
26	(2) The type of policy.
27	(3) The zip code of the property where the claim occurred.
28	(4) The parish where the claim occurred.
29	(5) The date of loss.

1	(6) The peril or type of loss, including information about the types of
2 vendors used for mitigation, repair, or replacement and the names of vendors
3 used, if known.
4	(7) The date the claim was reported to the insurer or the insurer group.
5	(8) The initial date the claim was closed, including information about
6 whether the claim was closed with or without payment.
7	(9) The date the claim was most recently reopened, if applicable.
8	(10) The date a supplemental claim was filed, if applicable.
9	(11) The date the claim was most recently closed, if different from the
10 initial date the claim was closed.
11	(12) The name of the public adjuster on the claim, if any.
12	(13) The Louisiana or other state bar number and name of the attorney
13 for the claimant, if any.
14	(14) The total indemnity paid by the insurer.
15	(15) The total loss adjustment expenses paid by the insurer.
16	(16) The amount paid for claimant's attorney fees, if any.
17	(17) The amount paid in costs for claimant's attorney's expenses,
18 including but not limited to expert witness fees.
19	(18) Any other information deemed necessary by the commissioner to
20 provide the department with the ability to track litigation and claim trends
21 occurring in the property market.
22	C. Each authorized insurer transacting insurance in this state that
23 provides personal or commercial residential coverage shall report on a calendar
24 year basis annually by April first for each line of insurance the following
25 information for direct Louisiana business only:
26	(1) Direct premiums written.
27	(2) Direct premiums earned.
28	(3) Loss reserves for all known claims at beginning of the year and at the
29 end of the year.

1	(4) Reserves for losses incurred but not reported at the beginning of the
2 year and at the end of the year.
3	(5) Allocated loss adjustment expense reserved at the beginning of the
4 year, reserved at the end of the year, and paid during the year.
5	(6) Unallocated loss adjustment expense reserved at the beginning of the
6 year, reserved at the end of the year, and paid during the year.
7	(7) Direct losses paid.
8	(8) Underwriting income or loss.
9	(9) Commissions and brokerage fees.
10	(10) Taxes, licenses, and fees.
11	(11) Other acquisition costs.
12	(12) General expenses.
13	(13) Policyholder dividends.
14	(14) Net investment gain or loss and other income gain or loss allocated
15 pro rata by earned premium to Louisiana business using the investment
16 allocation formula contained in the National Association of Insurance
17 Commissioner's Profitability Report by line by state.
18	D. The information submitted to the commissioner pursuant to the
19 provisions of this Section shall be considered confidential and exempt from the
20 provisions of law relative to public records as provided in R.S. 44:4.1(B)(11). All
21 information submitted to the commissioner pursuant to the provisions of this
22 Section shall be deemed to be proprietary and confidential business records and
23 are not subject to public examination or subpoena.
24	E. The commissioner shall promulgate rules and regulations and all
25 required forms for the implementation and enforcement of the provisions of this
26 Section no later than thirty days after the effective date of this Section.
27 Section 2. R.S. 44:4.1(B)(11) is hereby amended and reenacted to read as follows:

1	B. The legislature further recognizes that there exist exceptions, exemptions,
2 and limitations to the laws pertaining to public records throughout the revised
3 statutes and codes of this state. Therefore, the following exceptions, exemptions, and
4 limitations are hereby continued in effect by incorporation into this Chapter by
5 citation:

14 Section 3. This Act shall become effective on January 1, 2026.
