1 AN ACT
2 To enact R.S. 33:4710.13(A) and (B), relative to the Ernest N. Morial-New Orleans
3 Exhibition Hall Authority; to provide relative to the board of commissioners; to
4 provide relative to employment for certain persons after termination of public
5 service; to provide for an effective date; and to provide for related matters.
6 Notice of intention to introduce this Act has been published.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 33:4710.13(A) and (B) are hereby enacted to read as follows:
9 ยง4710.13. Powers and duties
10 A. The authority shall have all the powers and authority necessary or
11 convenient to carry out the purposes of this Chapter including but not limited to the
12 following powers and authority:

14 B. Notwithstanding the prohibition contained in R.S. 42:1121(A)(1)(2)
15 or any other law to the contrary, a commissioner with a masters of business
16 administration degree and at least thirty years of work experience in hospitality
17 or hotel management serving as of January 1, 2025 may be employed by the

1 authority regardless of when his public service terminated, upon a finding by
2 the board of commissioners that circumstances require such action. The
3 provisions of this Section shall terminate on December 31, 2025.
4 Section 2. This Act shall become effective upon signature by the governor or, if not
5 signed by the governor, upon expiration of the time for bills to become law without signature
6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
7 vetoed by the governor and subsequently approved by the legislature, this Act shall become
8 effective on the day following such approval.

Present law (R.S. 42:1121(A)(1)) provides that no former agency head or elected official
shall, for a period of two years following the termination of his public service as the head
of such agency or as an elected public official serving in such agency, assist another person,
for compensation, in a transaction, or in an appearance in connection with a transaction,
involving that agency or render any service on a contractual basis to or for such agency.
Proposed law retains present law.
Present law (R.S. 42:1121(A)(2)) provides that no former member of a board or commission
shall, for a period of two years following the termination of his public service on such board
or commission, contract with, be employed in any capacity by, or be appointed to any
position by that board or commission.
Proposed law retains present law but provides that a commissioner with a masters of
business administration degree and at least 30 years of work experience in hospitality or
hotel management serving as of January 1, 2025, may be employed, by the Ernest N. Morial-
New Orleans Exhibition Hall Authority, regardless of when his public service terminated,
upon a finding by the board of commissioners that circumstances require such action.
Proposed law provides that the provisions of proposed law shall terminate on December 31,
2025.
Effective upon signature of the governor or lapse of time for gubernatorial action.
