Expressing support for the recognition of March 10, 2023, as "Abortion Provider Appreciation Day".

Impact

The resolution highlights the challenges faced by abortion providers, particularly in states that have enacted restrictive abortion laws following the Supreme Court's Dobbs decision. As of March 2023, this decision has led to abortion bans in at least 12 states, impacting millions of Americans. The bill underlines the need for accessibility in abortion care, combating the logistical and financial hurdles patients face due to these restrictions. Furthermore, it affirms the commitment of Congress to support the safety and operational capacity of these providers.

Summary

HCR23 is a resolution expressing support for March 10, 2023, as 'Abortion Provider Appreciation Day.' This bill recognizes the critical roles that abortion providers and clinic staff play in delivering healthcare services, especially in an increasingly hostile environment post-Dobbs v. Jackson Women's Health Organization. The resolution aims to honor the courage and compassion of these professionals who ensure that individuals can make informed decisions about their reproductive health free from external pressures and dangers.

Contention

While HCR23 largely presents an appreciation of abortion providers, it subtly underscores the ongoing national debate surrounding reproductive rights. Supporters of the resolution, predominantly from the Democratic Party, view it as a necessary tribute to those providing essential healthcare. In contrast, opposition from anti-abortion groups may perceive it as an endorsement of practices they seek to restrict. The resolution also indirectly confronts the broader social implications of the Dobbs decision, emphasizing the precarious situation faced by marginalized communities in accessing reproductive healthcare.

Historical context

The bill serves as a reminder of the legacy of violence against abortion providers, marked by the memorialization of Dr. David Gunn, who was tragically murdered in 1993. This historical context provides a crucial backdrop for understanding the current climate surrounding abortion access and the need for continued vigilance and support for those in the field. By declaring this appreciation day, the resolution advocates for a future where the right to choose and access abortion is free from threats and legal barriers.

US HB12

Women's Health Protection Act of 2023 This bill prohibits governmental restrictions on the provision of, and access to, abortion services. Before fetal viability, governments may not restrict providers from using particular abortion procedures or drugs, offering abortion services via telemedicine, or immediately providing abortion services if delaying risks the patient's health. Furthermore, governments may not require providers to perform unnecessary medical procedures, provide medically inaccurate information, or comply with credentialing or other conditions that do not apply to providers who offer medically comparable services to abortions. Additionally, governments may not require patients to make medically unnecessary in-person visits before receiving abortion services or disclose their reasons for obtaining services. After fetal viability, governments may not restrict providers from performing abortions when necessary to protect a patient's life and health. The same provisions that apply to abortions before viability also apply to necessary abortions after viability. Additionally, states may authorize post-viability abortions in circumstances beyond those that the bill considers necessary. Further, the bill recognizes an individual's right to interstate travel, including for abortion services. The bill also prohibits governments from implementing measures that are similar to those restricted by the bill or that otherwise single out and impede access to abortion services, unless the measure significantly advances the safety of abortion services or health of patients and cannot be achieved through less restrictive means. The Department of Justice, individuals, or providers may sue states or government officials to enforce this bill, regardless of certain immunity that would otherwise apply.
