Caption

To codify certain provisions of certain Executive Orders relating to domestic mining and hardrock mineral resources, and for other purposes.

Impact

The implementation of HB 4090 could significantly alter federal policies concerning mining operations on federal lands. The bill instructs the Secretary of the Interior to prioritize and expedite the identification and approval of mining projects, especially those that promise a robust contribution to domestic mineral supply, essentially reducing permitting times for essential mining activities. Furthermore, the Secretary is tasked with reviewing current regulations to identify and amend those that may hinder mining development, representing a shift toward more business-friendly practices in the mining sector

Summary

House Bill 4090 aims to codify several provisions from existing Executive Orders related to domestic mining and the management of hardrock mineral resources. The bill reflects the policy to enhance the United States' position as a leading producer of hardrock minerals, including rare earth minerals. It emphasizes job creation, supply chain strengthening, and national security while aiming to curb reliance on foreign mineral imports. The overarching goal is to reduce the influence of adversarial nations over critical mineral supply chains vital for various industries.

Contention

Despite its goals, HB 4090 has raised concerns among environmentalists and regulatory advocates. Critics argue that prioritizing expedited mining approvals may compromise environmental protections and local regulations designed to safeguard natural ecosystems. The bill's direction towards deregulation in favor of increased mineral production has sparked debate over the potential environmental fallout, as it could expose sensitive lands to industrial exploitation. The balance between economic development and environmental integrity remains a contentious issue as lawmakers navigate the bill's provisions.

US HB1

Lower Energy Costs Act This bill provides for the exploration, development, importation, and exportation of energy resources (e.g., oil, gas, and minerals). For example, it sets forth provisions to (1) expedite energy projects, (2) eliminate or reduce certain fees related to the development of federal energy resources, and (3) eliminate certain funds that provide incentives to decrease emissions of greenhouse gases. The bill expedites the development, importation, and exportation of energy resources, including by waiving environmental review requirements and other specified requirements under certain environmental laws, eliminating certain restrictions on the import and export of oil and natural gas, prohibiting the President from declaring a moratorium on the use of hydraulic fracturing (a type of process used to extract underground energy resources), directing the Department of the Interior to conduct sales for the leasing of oil and gas resources on federal lands and waters as specified by the bill, and limiting the authority of the President and executive agencies to restrict or delay the development of energy on federal land. In addition, the bill reduces royalties for oil and gas development on federal land and eliminates charges on methane emissions. It also eliminates a variety of funds, such as funds for energy efficiency improvements in buildings as well as the greenhouse gas reduction fund.
