[SIMILAR MATTER FILED IN PREVIOUS SESSION SEE HOUSE, NO. 1993 OF 2021-2022.] The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act providing worker compensation protection to emergency response and medical personnel related to COVID-19 infection. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 Chapter 152 of the General Laws is hereby amended by inserting after section 7G the 2following section: 3 Section 7H: In any claim for compensation where the employee has been diagnosed with 4COVID-19, it shall be prima facie evidence that (i) the employee was performing his or her 5regular duties at the time of contracting COVID-19; (ii) the claim comes within the provisions of 6this chapter; and (iii) sufficient notice of the injury has been given. This section shall apply to 7health-care employees and non-medical employees at hospitals, chronic disease rehabilitation 8centers, nursing homes, rest homes, community health centers, psychiatric hospitals, out-patient 9health care facilities, health-care employees working in prisons and correctional facilities, at- 2 of 2 10home certified nursing assistants, at-home personal care assistants, emergency medical 11technicians, and paramedics.
