No. 261 By Representative Cassidy of Brockton (by request), a petition (accompanied by bill, House, No. 261) of Joseph Golden for legislation to establish a board of examiners of motor vehicle mechanics. Consumer Protection and Professional Licensure. The Commonwealth of Massachusetts _______________ In the One Hundred and Ninety-Third General Court (2023-2024) _______________ An Act relative to motor vehicle mechanics. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 Chapter 13 of the General Laws is hereby amended by adding the following section:- 2 Section 110. (a) There shall be within the division of professional licensure a board of 3examiners of motor vehicle mechanics to consist of the commissioner of public safety or his 4designee, the director of professional licensure or his designee and 5 persons, residents of the 5commonwealth, to be appointed by the governor for terms of 3 years, 4 of whom shall be motor 6vehicle mechanics with at least 10 years of practical experience and who are wage earners, and 1 7of whom shall be a representative of the public and subject to section 9B. 8 (b) No member shall serve for more than 2 consecutive and complete 3-year terms. As 9the term of the office of a member expires, a successor shall be appointed in like manner for a 10term of 3 years. The governor may fill a vacancy in the board for the unexpired portion of the 11term. 2 of 2 12 (c) The board shall annually elect from among its members a chairman and vice- 13chairman. The board shall meet at least 4 times annually and may hold additional meetings as 14necessary to discharge its duties. Members shall serve without compensation but shall be entitled 15to reasonable travel expenses. The members of the board shall be public employees for the 16purposes of chapter 258 for all acts or omissions within the scope of their duties as board 17members. 18 (d) The board shall have the following powers and duties: (i) establish such qualifications 19for the licensing of motor vehicle mechanics as may be necessary for the welfare of the public 20and the motor vehicle repair industry; provided that no individual shall be licensed as a motor 21vehicle mechanic without first receiving certification as provided for by the board; (ii) to adopt 22rules and regulations governing the licensure of motor vehicle mechanics, and business entities 23and schools teaching auto mechanic work; (iii) to establish standards of professional and ethical 24conduct; (iv) to establish standards for continuing education reflecting acceptable national 25standards; and (v) in conjunction with the division of professional licensure, to investigate 26complaints, conduct inspections, request and review business records of licensees, and set and 27administer penalties as defined in sections 61 to 65E, inclusive, of said chapter 112.
