An Act authorizing the town of Weston to grant a license for the sale of wines and malt 
beverages at a food store.

By Representative Peisch of Wellesley and Senator Barrett, a joint petition (accompanied by bill, 
House, No. 4001) of Alice Hanlon Peisch and Michael J. Barrett (by vote of the town) that the 
town of Weston be authorized to grant a license for the sale of wines and malt beverages at a 
food store in said town. Consumer Protection and Professional Licensure.  [Local Approval 
Received.]

An Act authorizing the town of Weston to grant a license for the sale of wines and malt 
beverages at a food store.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority 
of the same, as follows:
1 Section 1: Section 1 of Chapter 37 of the Acts of 2008 is hereby amended by adding the 
2word “any” prior to the words striking the words “such license” in line 5 of paragraph 1 and by 
3adding the words “issued hereunder” thereafter so that the sentence reads: Except as otherwise 
4provided herein, any such license issued hereunder shall be subject to all of said Chapter 138 
5except Section 17.”
6 Section 2: Section 1 of Chapter 37 of the Acts of 2008 is hereby amended striking the 
7words “the license” in line 3 paragraph 4 and substituting therefor the words “any license granted 
8hereunder” and in line 3 of paragraph 4 and substituting the words “a license” in line 3 and “such 
9license” in line 4 for “the license” in each location so that the sentence reads as follows: 
10“Notwithstanding any general or special rule or regulation to the contrary, the licensing authority 
11shall not approve the transfer of a license granted hereunder to any other location, but a license  2 of 2
12may be granted at the same location if an applicant for such license files with the authority a 
13letter in writing from the department of revenue indicating that the license is in good standing 
14with the department and that all applicable taxes have been paid.”
15 Section 3: Section 1 of Chapter 37 of the Acts of 2008 is hereby amended by striking the 
16words “the license” in line 1 of paragraph 5 and substituting therefor “a license” so that the 
17sentence reads as follows: “If a license granted under this Section is canceled, revoked or no 
18longer in use, it shall be returned physically, with all of the legal rights, privileges, and 
19restrictions pertaining thereto, to the licensing authority which may then grant the license to a 
20new applicant at the same location and under the same conditions as specified in this section.”
